PLANNING COMMISSION RESOLUTION NO. 3904
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA, APPROVING
PROPERTY GENERALLY LOCATED ON THE EAST
SIDE OF PI0 PIC0 DRIVE BETWEEN TAMARACK
AVENUE AND MAGNOLIA AVENUE

A SITE DEVELOPMENT PLAN NO. SDP 96-02 ON

8 WHEREAS, Don Edson Architects (Developer) has filed a
9 application with the City of Carlsbad and which has been referred to the E

Commission; and
12 I1 WHEREAS, said verified application constitutes a request for

22 WHEREAS, at said public hearing, upon hearing and considering all tes

and arguments, if any, of all persons desiring to be heard, said Commission consid(
factors relating to SDP 96-02.

26 NOW, THEREFORE, BE IT HEREBY RESOLVED by the PI
27 ll Commission of the City of Carlsbad as follows:
28 A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Commission
APPROVES Site Development Plan Approval, SDP 96-02, based on the
following findings and subject to the following conditions:

That the requested use is properly related to the site, surroundings and
environmental settings, is consistent with the various elements and objectives of the
General Plan, will not be detrimental to existing uses or to uses specifically permitted
in the area in which the proposed use is to be located, and will not adversely impact
the site, surroundings or traffic circulation, in that the proposed modular units will
be placed on the interior of the existing site where they will not be visible from the
south, east, or west of the church/campus property. The units will be visible from
the interior (parking area) of the property to the north. However, that property
contains a similar use (a church/school campus) and also includes similar modular
classroom units.
That the site for the intended use is adequate in size and shape to accommodate the
use, in that the project will provide adequate setbacks from the neighboring property
and adequate distances between structures, and sufficient parking will be provided
on site to accommodate the anticipated parking demand.
That all yards, setbacks, walls, fences, landscaping, and other features necessary to
adjust the requested use to existing or permitted future uses in the neighborhood will
be provided and maintained, in that adequate setbacks, walls, and landscaping are
being provided and maintained, and no new walls, fences, landscaping, or other
features will be required.
That the street systems serving the proposed use is adequate to properly handle all
traffic generated by the proposed use, in that the project is conditioned to pay a
traffic impact fee for additional trips to be generated by the addition classrooms, and
all existing access to the site will be maintained.
Conditions:
1. All of the conditions of approval contained in CUP 204(C) (Planning Commission
Resolution No. 3888) are included herein by reference.
2. This project is approved subject to the approval of CUP 204(C) (Planning
Commission Resolution No. 3888).
