CASE NAME: CALAVERA HEIGHTS VILLAGE "R1 CASE NO: CT 90-24x1 WHEREAS, the Planning Commission did on January 19, 1994, adopt Rt No. 3612, approving the tentative map for CT 90-24, Calavera Heights Village R WHEREAS, said tentative map would have expired as of January 19, 199r WHEREAS, the owner of the tentative map, Lyon Communities, Inc., has rl an extension of time to process toward a final map; and WHEREAS, the owner has been diligently pursuing a final map; and WHEREAS, the owner has said that the unfavorable economic conditions o several years has prevented the completion of processing for a final map; and WHEREAS, the design and improvements of the subdivision can be found conformance with the General Plan, Title 21, other City ordinances and current CitJ with the imposition of conditions of approval; and WHEREAS, the owner desires to extend the tentative map under the cond approval. NOW, THERE.FORE, BE IT RESOLVED by the Planning Commission of of Carlsbad, California, as follows: A) That the. foregoing recitations are true and correct. B) That the: Planning Commission APPROVES the request for an exte time for tentative map, CT 90-24, for a period of one year until Jan 1997, subject to all of the conditions of approval contained in 1 Commission Resolution No. 3612, based on the following findings an( to the fcdlowing additional condition: ~ .... The Planning Commission finds that: a) the project is a subsequent development project as defined in Section of the California Environmental Quality Act; b) the project is consistent with the Calavera Hills Master Plan; c) there was an EIR (EIR 90-05) certified in connection with the Calavc Master Plan (MP 150-G); d) the project has no new significant environmental effect not ana significant in the prior EIR (EIR 90-05); e) none of the circumstances requiring Subsequent or Supplemental E1 CEQA Guidelines Sections 15162 or 15163 exist; and f) all feasible mitigation measures or project alternatives identifiec previous EIR which are appropriate to this Subsequent Project ha incorporated into this Subsequent Project. 2. The design and improvements of the subdivision are consistent with the Plan, Titles 20 and 21 of this code and any public facility or deve management policies in existence at the time the extension is approved. 3. The subdivider is diligently pursuing those acts required to obtain Final Ma Subdivision. Conditions: 1.
