Y 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e a PLANNING COMMISSION RESOLUTION NO. 3911 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, GRANTING A ONE YEAR EXTENSION OF TIME FOR A PREVIOUSLY APPROVED TENTATIVE MAP. CASE NAME: CASA DEL SOL CASE NO: CT 89-23x3 WHEREAS, the Planning Commission did on February 21, 1990, adopt Re No. 2976, approving the tentative map for CT 89-23, Casa del Sol; and WHEREAS, said tentative map would have expired as of February 21, 191 WHEREAS, said map was extended for one year until February 21, 199: adoption of Planning Commission Resolution No. 3378; and WHEREAS, said tentative map was again extended for one year until Feb: 1994, by the adoption of Planning Commission Resolution No. 3521; and WHEREAS, on September 13, 1993, the State of California passed CA extending all active tentative maps for an additional two years; and WHEREAS, the expiration date of the tentative map is now February 21, 1' WHEREAS, the owner has applied for an extension of time to process towa~ map; and WHEREAS, the owner has been diligently pursuing a final map; and WHEREAS, the owner has said that the unfavorable economic conditions o several years have prevented the completion of processing for a final map; and WHEREAS, the design and improvements of the subdivision can be found conformance with the General Plan, Title 21, other City ordinances and current City with the imposition of conditions of approval; and WHEREAS, both the Planning Commission and the owner desire to ex1 tentative map under the conditions of approval. B) That the Commission APPROVES an extension of time for the tenta CT 89-23 for a period of one year until February 21, 1997, base findings and subject to all the conditions of approval contained in Commission Resolutions No. 3521, 3378 and 2976, and also basec following additional findings: Findinps: 1. The Planning Commission finds that: a) Based on the EIA Part-11, this Subsequent Project was described in tl 93-01 as within its scope; AND there will be no additional significa not analyzed therein; AND that no new or additional mitigation me; alternatives are required; AND therefore this Subsequent Project is TI scope of the prior EIR and no new environmental document no Resources Code 21081 findings are required; b) The project is a subsequent development project as defined in Section of the California Environmental Quality Act; c) The project is consistent with the previously approved Casa del Sol d) There was a Negative Declaration approved in connection with the Sol project; e) The project has no new significant environmental effect not ana significant in the prior Negative Declaration; and f) None of the circumstances requiring Subsequent or Supplemental El CEQA Guidelines Sections 15162 or 15163 exist. 8) The design and improvements of the subdivision are consistent 7 General Plan and Titles 20 and 21 of the Municipal Code in applicable Engineering and development standards are complied with proposed project implements the residential land use designatio] General Plan for the subject property. h) The project is consistent with any and all applicable public fa development management policies currently in existence in that tht complies with the city’s Growth Management Program and no adverse to the services or facilities of Local Facilities Management Zone 6 w ~ PC RES0 NO. 3911 -2- I I’ 6 e !- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ~ from the approval of this extension request. 2. The project, as designed, implements certain objectives and mitigation I established by the General Plan Master EIR to reduce cumulative air qualitJ as applicable to a residential project of this scale. These include: provid to public sidewalk systems; providing for safe pedestrian and bicycle mc within the project; and designing the project to accommodate pedestrian s well as proposed parking areas and building locations.
