CASE NAME: RANCHO CARRILLO VILLAGE E CASE NO: CT 95-06 WHEREAS, UDC Homes has filed a verified application for certain p COMMON RECREATION LOTS AND 104 MULTI-FAMILY to wit: Portion of Section 24, Township 12 South, Range 4 West, San Bernardino Meridian and a portion of Sections 18 and 19, Township 12 South, Range 3 West, San Bernardino Meridian, and a portion of Certificate of Compliance File/Page 87-385114 recorded July 9,1987 all in the City of Carlsbad, County of San Diego, State of California. with the City of Carlsbad which has been referred to the Planning Commission; am WHEREAS, said verified application constitutes a request for a Tel Tract Map as provided by Chapter 20 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 17th day of April, hold a duly noticed public hearing as prescribed by law to consider said request; an WHEREAS, at said public hearing, upon hearing and considering all test and arguments, if any, of all persons desiring to be heard, said Commission consider factors relating to the Tentative Tract Map. That the Planning Commission has considered, in connection with the proposed by this subdivision, the housing needs of the region, and balanct housing needs against the public service needs of the City and available fi! environmental resources. 8. In addition to City Engineering Standa~ compliance with the City’s Master Sewer and Drainage Plans, National PI Discharge Elimination System (NPDES) standards will be satisfied to preb discharge violations. 10. The Planning Commission finds that the project, as conditioned herein for Carrillo Village E, is in conformance with the Elements of the City’s Gener based on the following: a. Land Use - The project is consistent with the City’s General Plan Res Medium High (RMH) land use designation since the proposed densit du/acre is below the density range of 8 - 15 du/acre specified for the indicated on the Land Use Element of the General Plan, and is at o the growth control point of 11.5 du/ac. b. Circulation - The project is conditioned to complete all necessary on! offsite roadway improvements prior to occupancy of any unit in eack Additionally, all roadway improvements to serve the Rancho Carrillo Plan must be guaranteed and substantially completed prior to occuy: units in Village E. c. Noise - The project provides mitigation to reduce noise levels to ( within the usable yard area of lots abutting Palomar Airport Road, i project is conditioned to require compliance with the 45 dBA interia standard. d. Housing - That the project is consistent with Policy 3.6.a of the € Element of the General Plan and the Inclusionary Housing Ordinana Developer has been conditioned to enter into an Affordable € Agreement to provide and deed restrict 20 dwelling units as afford lower-income households. The project also includes six affordabl bedroom duplex condominium units to satisfy the three bedroo requirement for UDC Homes in Villages E, J, and K. e. Open Space and Conservation - The project is consistent with the 1 Carrillo Master Plan and Zone 18 LFMP in that 186 acres of perf01 standard open space will be provided throughout the Master Plan. .... The developer has agreed and is required by the inclusion of an appr condition to pay a public facilities fee. Performance of that contr: payment of the fee will enable this body to find that public facilities available concurrent with need as required by the General Plan. 12. The project has been conditioned to pay any increase in public facility fee, ( construction tax, or development fees, and has agreed to abide by any add requirements established by a Local Facilities Management Plan prepared PI to Chapter 21.90 of the Carlsbad Municipal Code. This will ensure cor availability of public facilities and will mitigate any cumulative impacts created project. .... I/ PC RES0 NO. 3919 -4- 1 0 0 1 13. This project has been conditioned to comply with any requirement approved of the Local Facilities Management Plan for Zone 18. 2 3 14. The Planning Commission finds that all feasible mitigation measures or alternatives identified in the MEIR 93-01 which are appropriate to this Sub5 4 15. The Planning Commission finds that: 5 Project have been incorporated into this Subsequent Project. 6 7 8 9 10 11 12 13 14 a. the project is a subsequent development as described in CEQA Guj 1516S(c)(2) and (e), and 15183; b. the project is consistent with the General Plan Master EIR (MEIR 934 Rancho Carrillo Master Plan EIR (EIR 91-04); c. there were EIR’s certified in connection with the prior 1994 Gener; Update and Rancho Carrillo Master Plan; d. the project has no new significant environmental effect not analg significant in the prior EIR’s; e. none of the circumstances requiring Subsequent or a Supplemental EIR CEQA Guidelines Sections 15162 or 15163 exist. 15 16. The Planning Commission finds that all feasible mitigation measures or this Subsequent Project have been incorporated into this Subsequent Projeci 16 alternatives identified in the MEIR 93-01 and EIR 91-04 which are appropr 17 17. MEIR 93-01 found that air quality and circulation impacts are significal 18 adverse; therefore, the City Council adopted a statement of over considerations. The project is consistent with the General Plan and as to 19 effects, no additional environmental document is required. 20 21 22 23 24 18. The project, as designed, implements certain objectives and mitigation me, established by the General Plan Master EIR to reduce cumulative air quali circulation impacts as applicable to a residential project of this scale. These in providing links to public sidewalk systems that connect with transpor corridors, and future schools, parks, and trail systems; providing for safe pede and bicycle movements within the project; and designing the project to accomn pedestrian spaces as well as proposed parking areas and building locations. 25 19. The project is consistent with the Comprehensive Land Use Plan (CLUP) f 20 20. The Planning Commission has reviewed each of the exactions imposed Developer contained in this resolution, and hereby finds, in this case, tl exactions are imposed to mitigate impacts caused by or reasonably related project, and the extent and the degree of the exaction is in rough proportion; the impact caused by the project. Planning Conditions: I 1. The Planning Commission does hereby recommend approval of the Tentativl Map for the multi-family lot subdivision project entitled "Rancho CarrilloVil! (Exhibits "A-V" on file in the Planning Department and incorporated reference, dated April 17, 1996), subject to the conditions herein set forth. I authorized and directed to make or require the Developer to make all corri and modifications to the approved Documents, as necessary to make them int consistent and conform to City Council's final action on the project. Develc shall occur substantially as shown on the approved exhibits. Any prl development substantially different from this approval, shall require an amer to this approval. 2. Approval of CT 95-06 is granted subject to the approval of PUD 95-04 and SI 12. CT 95-06 is subject to all conditions contained in Planning Comn Resolutions No. 3919,3920, and 3921 dated April 17, 1996. 3. The Developer shall comply with all applicable provisions of federal, state, an ordinances in effect at the time of building permit issuance. 4. The Developer shall provide the City with a reproducible 24" x 36", mylar copy Tentative Map/Site Plan as approved by the final decision making body. Tentative MapISite Plan shall reflect the conditions of approval by the City Mapplan copy shall be submitted to the City Engineer and approved pr building, grading, final map, or improvement plan submittal, whichever occur 5. The final map shall not be approved unless the City Council finds as of the t: such approval that sewer service is available to serve the subdivision. 6. The Developer shall pay the public facilities fee adopted by the City Council o 28, 1987 (amended July 2, 1991) and as amended from time to time, an development fees established by the City Council pursuant to Chapter 21.90 Carlsbad Municipal Code or other ordinance adopted to implement a g management system or Facilities and Improvement Plan and to fulfill the subdi\ agreement to pay the public facilities fee dated September 5, 1995, a copy of is on file with the City Clerk and is incorporated by this reference. All future development in Zone 18 will be required to construct any Zone 18 storm drain facilities identified in the current Drainage Mast8 and revised Drainage Master Plan as determined by the City Enghet c. The Developer shall prepare a detailed landscape and irrigation plan in confon with the approved Preliminary Landscape Plan and the City’s Landscape M The plans shall be submitted to and approval obtained from the Planning DI prior to the approval of the final map, grading permit, or building permit, whic occurs first. The Developer shall construct and install all landscaping as sha the approved plans, and maintain all landscaping in a healthy and thriving cont free from weeds, trash, and debris. 9. The first submittal of detailed landscape and irrigation plans shall be accoml by the project’s building, improvement and grading plans. 10. Slope trees adjacent to Street B shall be minimum 15 gallon in size along the slope. 11. The Developer shall provide proof of payment of statutory school fees to mi conditions of overcrowding as part of the building permit application. The ar of these fees shall be determined by the fee schedule in effect at the time of bu permit application. 12. The Developer shall display a current Zoning and Land Use Map in the sales at all times, or suitable alternative to the satisfaction of the Planning Direct0 I .... All sales maps that are distributed or made available to the public shall inch not be limited to trails, future and existing schools, parks, and streets. 14. In accordance with the Rancho Carrillo Master Plan, prior to final ma applicant shall establish both a Master and Village homeowner's associatic corresponding covenants, conditions and restriction (CC&Rs). Said CC&Rs s submitted to and approved by the Planning Director. The following items s: included in the CC&Rs for each association as indicated: Master HOA a. Master Homeowner's Association maintenance of the Recreational 7 Storage Lot (Lot 104 of CT 93-04). b. The CC&Rs shall prohibit the storage or parking of recreational v within any of the Villages except in approved RV storage areas. 11 12 13 14 15 16 c. The Master Association shall control the operation and maintenance recreation vehicle storage area, entry signs, common slopes and common features as identified in the Master Plan. d. The provision of the Master CC&Rs shall be binding to the provisions CC&Rs for the Village Associations and may not conflict. The replacement ( fences or walls within this project must be consistent with one of the ft or wall design types as shown in the Master Plan. c. Provisions for HOA maintenance of open space Lots A&B. d. All open space and landscaped areas shall be maintained in a health; thriving condition, free from weeds, trash, and debris and shall be maint as indicated on Exhibit "E". All signage shall be designed in conformance with the Rancho Carrillo Maste Signage shall be located in conformance with Exhibit "F" Landscape Concept : unless otherwise approved by the Planning Director. Environmental: 18. The Developer shall diligently implement, or cause the implementation mitigation measures identified in the Final EIR 91-04 that are found 1 resolution to be feasible. The Developer shall also implement, or cau implementation of, the attached Rancho Carrillo Master Plan EIR 91-04 Miti Monitoring and Reporting Program (Exhibit "X1') certified by the City COUK July 27, 1993. 19. The Developer, or their successors in interest, shall improve the project Site wj project as described in the Final EIR 91-04, except as modified by this res011 20. Paleontology: a. Prior to any grading of the project site, a paleontologist shall be retail perform a walkover survey of the site and to review the grading pl: determine if the proposed grading will impact fossil resources. A copy paleontologist's report shall be provided to the Planning Director pr issuance of a grading permit; b. A qualified paleontologist shall be retained to perform periodic inspe of the site and to salvage exposed fossils. Prior to occupancy of individual units, the applicant shall construct the com theme/noise attenuation walls shown on Exhibit "E", Landscape Concept Plar April 17, 1996 in accordance with the addendum to the "Acoustical Anal?
