A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA,
RECOMMENDING APPROVAL OF A 115 LOT PLANNED
DEVELOPMENT PERMIT WITH 104 DUPLEX UNITS ON
PROPERTY GENERALLY LOCATED SOUTH OF
PALOMAR AIRPORT ROAD BETWEEN FUTURE
MELROSE DRIVE AND THE CITY'S EASTERN
BOUNDARY.

WHEREAS, UDC HOMES has filed a verified application for certain p
to wit:
Portion of Section 24, Township 12 South, Range 4 West, San
Bernardino Mefidian and a portion of Sections 18 and 19,
Township 12 South, Range 3 West, San Bernardino Meridian,
and a portion of Certificate of Compliance Filepage 87-385114
recorded July 9,1987 all in the City of Carlsbad, County of San
Diego, State of California.
with the City of Carlsbad which has been referred to the Planning Commission; an
WHEREAS, said verified application constitutes a request for a Plannc
Development as provided by Chapter 21.45 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 17th day of April,
hold a duly noticed public hearing as prescribed by law to consider said request; ar
WHEREAS, at said public hearing, upon hearing and considering all tes'
and arguments, if any, of all persons desiring to be heard, said Commission conside:

NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1:
Commission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Comm
RECOMMENDS APPROVAL of Planned Unit Development, PUD
based on the following findings and subject to the following condition:

Findings:
1. That the granting of this permit will not adversely affect and will be consist€
Chapter 21.45 of Title 21, the General Plan, the Rancho Carrillo Master P1.
all adopted plans of the City and other governmental agencies, in that the
family medium high density residential project implements the designated (
Plan and Master Plan land use and incorporates all required development sta
and design criteria specified by the Planned Development Ordinance.
2. That the proposed use at the particular location is necessary and desirable to 1
a service or facility which will contribute to the long-term general well-being
neighborhood and the community, in that the multi-family developme,
contribute to the balance of housing types in the City.
3. That such use will not be detrimental to the health, safety, or general we1
persons residing or working in the vicinity, or injurious to property or improv
in the vicinity, in that the project is conditioned to comply with the Zone It
Facilities Management Plan ensuring that the necessary public facilitil
infrastructure will be provided concurrent with demand and that grading wi
accordance with the provisions of the Grading Ordinance and the recommenc
of the geotechnical analysis.
4. That the proposed Planned Development meets all of the minimum develc
standards set forth in Chapter 21.45.090, the design criteria set forth in :
21.45.080, and has been designed in accordance with the concepts contained
Design Guidelines Manual, in that the project provides the necessary privatt
widths, conveniently located common recreation areas, adequate resident ant
parking, setbacks, and landscaping.
5. That the proposed project is designed to be sensitive to and blend in with the r
topography of the site, and maintains and enhances significant natural resour
the site, in that the project grading is consistent with the approved Rancho C
Master Plan Hillside Development Permit, HDP 91-17, and units will p
variation in architecture and roof colors as well as landscaping and uniform f

7. That the project’s circulation system is designed to be efficient and well intel

will provide automobile and pedestrian access to each of the duplex unit

to the individual units.
8. The Planning Commission finds that:
a. the project is a subsequent development as described in CEQA Gu
15168(c)(2) and (e), and 15183:
b. the project is consistent with the General Plan Master EIR (MEIR 93
Rancho Carrillo Master Plan EIR (EIR 91-04).
c. there was an EIR certified in connection with the prior 1994 Gene1
and Rancho Carrillo Master Plan
d. the project has no new significant environmental effect not anal,
significant in the prior EIR’s;
e. none of the circumstances requiring Subsequent or a Supplemental E11
CEQA Guidelines Sections 15162 or 15163 exist;
9. The Planning Commission finds that all feasible mitigation measures or
alternatives identified in the MEIR 93-01 and EIR 91-04 which are approp
this Subsequent Project have been incorporated into this Subsequent Projec
10. MEIR 93-01 found that air quality and circulation impacts are significa

11. The project is consistent with the Comprehensive Land Use Plan (CLUP)

13. The Planning Commission has reviewed each of the exactions imposed

the impact caused by the project.
Conditions:
1. Approval of PUD 95-04 is granted subject to the approval of CT 95-06 and SI
