A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA, APPROVING
AFFORDABLE SECOND DWELLING UNITS IN RANCHO
CARRILLO VILLAGE J AND K ON PROPERTY
GENERALLY LOCATED SOUTH OF PALOMAR
AIRPORT ROAD, NORTH OF POINSETTIA LANE AND
ADJACENT TO BOTH SIDES OF FUTURE MELROSE
DRIVE

WHEREAS, UDC HOMES has filed a verified application with the C
SITE DEVELOPMENT PLAN NO. SDP 95-13 FOR 27
AND K
Carlsbad which has been referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request for a
Development Permit approval as shown on Exhibits "A"-"CC" dated May 15, 1996, o
in the Planning Department and incorporated herein by this reference ("SDP 95-13":
as provided by Chapter 21.53 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Plar
Commission did, on the 15th day of May, 1996, consider said request on property desc~
as:
Portion of Section 24, Township 12 South, Range 4 West, San
Bernardino Meridian and a portion of Sections 18 and 19,
Township 12 South, Range 3 West, San Bernardino Meridian,
all in the City of Carlsbad, County of San Diego, State of
California.
WHEREAS, at said public hearing, upon hearing and considering all testir
and arguments, if any, of all persons desiring to be heard, said Commission considere
factors relating to SDP 95-13.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Comn
RECOMMENDS APPROVAL of a Site Development Permit, SDP
based on the following findings and subject to the following condition
Findings:
1. All findings contained in Planning Commission Resolutions No. 3931 and 39
CT 93-01 and PUD 95-05 are incorporated herein by reference.
2. That the requested use is a) properly related to the site, surrounding
environmental settings, b) is consistent with the various elements and objectj
the General Plan, c) will not be detrimental to existing uses or to uses specj
permitted in the area in which the proposed use is to be located, and d) w
adversely impact the site, surroundings or traffic circulation, in that:
a. The affordable units are consistent with the City's Inclusionary Hc
Ordinance (Chapter 21.85 of the Zoning. Ordinance) due to proxim
Palomar Airport Road and Melrose Drive, both prime arterial roadway
within 0 - 2 miles of three major industrial centers offering emplo;
opportunities. All public facilities, including the construction of M
Drive as well as the necessary infrastructure to serve the project ar
necessary environmental mitigation will bme provided;
b. The 27 affordable units in Villages J and K are located within the R;
Carrillo Master Plan area. In accordance with Policy 3.6.a of the Ho
Element requiring that 15% of all units approved for any master
community shall be affordable to lower income households, the 27 affor

3. That the site for the intended use is adequate in size and shape to accommoda
use, in that since the units are integrated into the single family development 1

4. That all yards, setbacks, walls, fences, landscaping, and other features necess;

incorporated into the individual dwellings.
5. That the street systems serving the proposed use is adequate to properly hanc
traffic generated by the proposed use, in that ingress and egress to and from
project will be provided by public streets designated by the Rancho Carrillo M
Plan and the required improvements to the internal and external circulation SJ
required for the project will ensure that all roadways conform to City Standard;
operate at acceptable levels in accordance with Growth Management standarc
road segments and intersections.
Conditions:
1. Approval of SDP 95-13 is granted subject to the approval of CT 93-01 and PUI
05. SDP 95-13 is subject to all conditions contained in Resolution No. 3931 fo
Tentative Tract Map, CT 93-01.
2. The project shall comply with all conditions and mitigation measures whicl-
required as part of the approved CT 93-01 and PUD 95-05 as contained in Plar
Commission Resolutions No. 3931 and 3932
