A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT
IMPRVOVEMENT PROGRAM IS CONSISTENT WITH THE
GENERL PLAN.
CASE NAME: 1996-1 997 SUPPLEMENT TO THE
BUILDOUT CAPITAL IMPROVEMENT
THE 1996-1997 SUPPLEMENT TO THE BUILDOUT CAPITAL
PROGRAM
CASE NO: PCD/GPC 96-01
WHEREAS, the City of Carlsbad has filed a verified application
for property Citywide, which has been referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request for a
Planning Commission Determination of General Plan Consistency as provided
by Section 65401 of the California Government Code; and
WHEREAS, the Planning Commission did on the 5th day of June,
1996, consider said request; and
WHEREAS, at said hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said
Commission considered all factors relating to the Planning Commission
Determination; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the
Planning Commission as follows:
A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the hearing, the
Planning Commission DETERMINES that PCD/GPC 96-
01 is consistent with the General Plan, based on the
following findings and subject to the following condition:

Findings:
1. This project is consistent with the goals and policies of the City’s
General Plan which ensures and requires the provision of adequate
public facilities and services concurrent with or prior to actual
demand.
2. The project is consistent with the Circulation, Land Use, Public
Safety, Parks and Recreation and Arts Elements of the General Plan.
Specifically, a goal of the Land Use Element requires that public
facilities be adequate for the projected population. The CIP
implements this goal.
3. As provided for in the General Plan, the proposed improvements are
consistent with the City’s Growth Management Plan, specifically by
ensuring that necessary improvements are provided for streets, traffic
signals, parks, sewer systems, water systems, drainage facilities and
civic projects in accordance with the performance standards of
Growth Management.
Condition:
1. All projects within the 1996-1997 supplement to the Buildout Capital
Improvement Program shall undergo environmental review per Title
19 of the Carlsbad Municipal Code. Any mitigation measures
determined during the project’s environmental review shall be
complied with in their entirety unless environmental findings and
overriding considerations are made by the City Council.
