PLANNING COMMISSION RESOLUTION NO. 3944
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAIUSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A MASTER PLAN AMENDMENT FOR
PROPERTYGENEMLLYLOCATEDSOUTHOFLACOSTA
AVENUE, NORTH AND EAST OF THE CITY OF ENCINITAS,
AND WEST OF EL CAMINO REAL IN LOCAL FACILITIES
MANAGEMENT ZONE 23.
CASE NAME: GREEN VALLEY MASTER PLAN
CASE NO: MP 92-0 1 (A)
WHEREAS, Carlsbad Partners, LTD. filed a verified application whicl
referred to the Planning Commission; and
WHEREAS, said verified application constituted a request for a Master Pla
Local Coastal Program Amendment as provided by Chapters 21.38 and 21.52 of the Car
Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Pla
Commission did consider said request for a Master Plan and Local Coastal Program' Amend
and
WHEREAS, at said public hearing, upon hearing and considering all testi~
and arguments, if any, of all persons desiring to be heard, said Commission considered all fi
relating to the Master Plan and Local Coastal Program Amendment and recommended app
of the Master Plan and Local Coastal Program Amendment to the City Council; and
WHEREAS, pursuant to the provisions of the Municipal Code, the City Cc
did consider said request for a Master Plan and Local Coastal Program Amendment
approved the Master Plan and Local Coastal Program Amendment; and
WHEREAS, the California Coastal Commission considered the Master Pk
May 7th, 1996, as an amendment to the Local Coastal Program to adopt the Master Plan 2
implementing Ordinance for the Green Valley area of the East Batiquitos Lagoolu

1 Properties segment of the Carlsbad Local Coastal Program and approved the Master Plar

WHEREAS, the verified application has been referred back to the Pla
Commission as an amendment as shown on draft City Council Ordinance, Exhibit “A” datec
3, 1996, on file with the Planning Department for acceptance of the suggested modific,
made by the California Coastal Commission; and

Commission did, on the 3rd day of July 1996, consider said request for a Master 9
WHEREAS, pursuant to the provisions of the Municipal Code, the Pla

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla

A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Pla
Commission RECOMMENDS APPROVAL of Master Plan Amendment
92-01(A), as shown on Exhibit “A”, attached, based on the following findin,
subject to the following condition:
Finding:
1. That the proposed amendments as described by draft City Council Ordinance Ex
“A” are consistent with the provisions of the General Plan and the Green V
Master Plan in that they are measures which implement the intent of open !!
preservation, natural habitat protection and enhancement, and public acce
open space.
