A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A ZONE CODE AMENDMENT, AMENDING
TITLE 21, CHAPTER 21.42 OF THE CARLSBAD MUNICIPAL
CODE, TO ACCEPT SUGGESTED MODIFICATIONS TO THE
BIOLOGICAL HABITAT PRESERVE SECTION 21.42.01 O(15)
APPROVED BY THE CALIFORNIA COASTAL
COMMISSION.

CASE NO: ZCA 96-05
WHEREAS, California State law requires that the Local Coastal Pro
General Plan and Zoning designations for properties in the Coastal Zone be in conformance:
WHEREAS, on May 7, 1996, the California Coastal Commission approv
amendment to the Carlsbad Implementation Plan with three suggested modifications; and
WHEREAS, before the original amendment request can become effec
certified, the Executive Director of the California Coastal Commission must rc
documentation that the City has accepted the suggested modifications; and
WHEREAS, the Planning Commission did on the 3rd day of July, 1996, k
duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, said application constitutes a request for a zone code amendmc
shown on Exhibit “A”, dated May 23, 1996, attached hereto and made a part hereof, as pro
by Chapter 21.52 of the Carlsbad Municipal Code; and
WHEREAS, at said public hearing, upon hearing and considering all testil
and arguments, if any, of all persom desiring to be heard, said Commission considered all fi
relating to the Zone Code Amendment.

A) That the foregoing recitations are true and correct.
B) The Planning Commission RECOMMENDS APPROVAL of Zone
5 Amendment, ZCA 96-05, based on the following findings:

Findings:
1. The proposed amendment is required in order to accept suggested modific:
approved by the California Coastal Commission.
2. The proposed amendment will retain consistency between Title 21 anc
implementation plan for the Local Coastal Program as approved by the Calif
Coastal Commission.
