HomeMy WebLinkAbout1996-08-07; Planning Commission; Resolution 3968r ‘c 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 PLANNING COMMISSION RESOLUTION NO. 3968 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CODE AMENDMENT, AMENDING TITLE 21, CHAPTER 21.41 OF THE CARLSBAD MUNICIPAL CODE, TO ALLOW SPECIFIED PROPERTIES WITHIN THE FLAG WHEN FLOWN IN TRADITIONAL COMBINATION WITH THE FEDERAL AND STATE FLAGS. CASE NAME: CORPORATE FLAGS CASE NO: ZCA 96-08 M, C-M AND P-M ZONES TO MAINTAIN A COMPANY WHEREAS, the Planning Director, pursuant to Section 21.52.020 of the C~J Municipal Code, has initiated a Zone Code Amendment to allow corporate flags under c circumstances; and WHEREAS, the Planning Commission did on the 7th day of August 1996,l duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testi~ and arguments, if any, of all persons desiring to be heard, said Commission considered all f: relating to the Zone Code Amendment; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla: Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the P1a1 Commission RECOMMENDS APPROVAL of Zone Code Amend] ZCA 96-08, according to Exhibit “X”, dated August 7, 1996, at% hereto and made a part hereof based on the following findings. Findings: 1. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTER 21.41 BY THE ADDITION OF SUBSECTION 21.41.070(11) TO ALLOW A SINGLE TENANT LOT OR BUILDING, HOUSING A NON-CONDITIONALLY M ZONE TO MAINTAIN A COMPANY FLAG DISPLAYING A COMPANY LOGO, INSIGNIA OR REGISTERED TRADEMARK WHEN FLOWN ON A FLAGPOLE IN TRADITIONAL COMBINATION WITH THE FEDERAL AND STATE FLAGS. CASE NAME: CORPORATE FLAGS CASE NO.: ZCA 96-08 The City Council of the City of Carlsbad, California, does ordain as follows: SECTION I: That Title 21, Chapter 21.41 of the Carlsbad Municipal Cc PERMITTED, NON-RETAIL USE WITHIN THE M, C-M, OR P- amended by the addition of subsection 21.41.070(11) to read as follows: "21.41.070(11) In addition to all other signs otherwise herein allowed, a single tenant I building, housing a non-conditionally permitted, non-retail use within the M, C-M, or P-M may maintain a company flag displaying a company logo, insignia, or registered trademark flown on a flagpole in traditional combination with the Federal and State flags. Such con flag shall be no larger than four feet by six feet in size and no more than one flag per bus entity within the City's corporate boundaries is allowed. Such company flag shall not ( towards the allowable signage area, but shall be allowed only as part of an integrated program subject to the approval of the Planning Director." EFFECTIVE DATE: This ordinance shall be effective thirty days aftc adoption, and the City Clerk shall certifjr to the adoption of this ordinance and cause it .I published at least once in a publication of general circulation in the City of Carlsbad w fifteen days after its adoption. Not withstanding the preceeding, this ordinance shall nc effective until approved by the California Coastal Commission.
