CASENAME: CARLSBAD RANCH HOTEL AND CASE NO.: PUD 96-01 WHEREAS, Grand Pacific Resorts, Inc. “Developer”, has filed a vc application with the City of Carlsbad regarding property owned by CARLTAS, “Ov described as DEVELOPMENT PERMIT NO. PUD 96-01 FOR AN 8 LOT TIMESHARE RESORT Lot 14 of Carlsbad Tract No. 92-7 in the City of Carlsbad, County of San Diego, State of California, according to map thereof No. 13215, filed in the Office of the County Recorder of San Diego County on June 30,1995. (“the Property”); and WHEREAS, said verified application constitutes a request for a Nonresidt Planned Unit Development Permit as shown on Exhibits “A” - “V”, dated September 18, : on file in the Carlsbad Planning Department (Carlsbad Ranch Hotel and Timeshare Rt CUP 96-11), as provided by Chapter 21.47 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 18th day of September hold a duly noticed public hearing to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testiI and arguments, if any, of all persons desiring to be heard, said Commission considered all. fa relating to PUD 96-01. ... b" r' 0 8 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1: Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Comim RECOMMENDS APPROVAL of Nonresidential Planned Unit Develo: Permit, PUD 96-01, based on the following findings and subject to the folb conditions: Findings: 1. That the granting of this permit will not adversely affect and will be consistent wi City code, the General Plan, applicable specific plans, master plans, and all adopted of the City and other governmental agencies, in that the project is consistent vvil Carlsbad Ranch Specific Plan which implements the General Plan on this pro] The proposed uses are consistent with the specific plan and the nonresid, planned development permit provides a means for separate ownership of lot timeshare units as well as facilitating financing arrangements for the project. 2. That the proposed use at the particular location is necessary and desirable to pro\ service or facility which will contribute to the general well-being of the neighbol and community, in that the proposed land uses on site consisting of a hotel, tim.es and restaurants on the same development site are permitted land uses b! Carlsbad Ranch Specific Plan and require the creation of the pro1 nonresidential lots to provide for development of the various uses in one Pllar Area of the Carlsbad Ranch. 3. That such project will not be detrimental to the health, safety or general welfa persons residing or working in the vicinity, or injurious to property or improvenler the vicinity, in that creation of the 8 lots and 161 timeshare units by nonresidential planned unit development permit allows for the development project which meets all city standards. The Planning Commission does hereby recommend approval of the Non-resid1 Planned Unit Development Permit for the Carlsbad Ranch Hotel & Time Resort project entitled “PUD 96-01”, (Exhibit “A”-“V” dated September 18, 119’ file in the Planning Department and incorporated by this reference), subject tc conditions herein set forth. Staff is authorized and directed to make or requir Developer to make all corrections and modifications to the Non-residential €’la Unit Development documents, as necessary to make them internally consistent a conformity with final action on the project. Development shall occur substantial shown on the approved exhibits. Any proposed development substantially different this approval, shall require an amendment to this approval. 8 2. Approval of PUD 96-01 is granted subject to the approval of SDP 96-01, CT 96-01 Resolutions No. 3986,3987 and 3989 for the Site Development Plan, Tentative 1 9 CUP 96-11.
