CASE NAME: RANCHO CARLSBAD MOBILEHOME PARK CASE NO: ZC 96-04 WHEREAS, Carlsbad Resident Association, Inc., “Developer” has fi verified application with the City of Carlsbad regarding property owned by Carlsbad Re? Association, Inc., Carlsberg Rancho, LTD, Brookdale Terrace Building Company Oak Shadows Building Company “Owner”, described as CONTROL (L-C) TO RESIDENTIAL MOBILEHOME PARK A portion of Lot “B” and Lot “E” of Rancho Agua Hedionda, in the City of Carlsbad, County of San Diego, State of California, per map thereof No. 823, filed in the office of the County Recorder of said county, November 16,1896. (“the Property”); and WHEREAS, said application constitutes a request for a Zone Change as shoT Exhibit “A”, dated December 18, 1996, on file in the Planning Department, Zone Chang 96-04 as provided by Chapter 21.37 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the Mth day of December, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testi: and arguments, if any, of all persons desiring to be heard, said Commission considered all f: relating to the Zone Change; and I , I ... B) That based on the evidence presented at the public hearing, the Comm RECOMMENDS APPROVAL of Zone Change, ZC 96-04, based o following findings: Findings: 1. That the proposed Zone Change from L-C to RMHP is consistent with the goal policies of the various elements of the General Plan, in that the RLM General designation of the property. permits residential development in the range of 0 du/ac, with a 3.2 du/ac growth management control point and at zero du/a project is within the density range. As provided for in the Land Use Element, E C.6, cluster-type housing is encouraged where the design provides adequate space areas around the multiple family development. In this case, the clusterin allowed the mobilehome spaces to be located together with the general open SI recreation uses, and RV storage facility to be located on the perimeter of the sit€ 2. That the Zone Change will provide consistency between the General Plan and Zoni mandated by California State law and the City of Carlsbad General Plan Land Element, in that the Rancho Carlsbad Mobilehome Park is an existing use 01 property and the proposed rezoning of the site to RMHP will provide consisl between the existing use and the zoning. Further, the existing RLM General designation of the site, which permits residential development and associ residential uses at a density range from 0 to 4 du/ac, is consistent with the exi; open space, recreational uses and RV storage use on the site. 3. That the Planning Director has determined that the project is exempt from requirements of the California Environmental Quality Act (CEQA) per Se 15061(b)(3) of the state CEQA Guidelines and will not have any adverse signif impact on the environment. ... ... ... ...
