A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
HILLSIDE DEVELOPMENT PERMIT EXCLUSION ON
PROPERTY GENERALLY LOCATED EAST OF EL CAMINO
REAL AND NORTH OF CARLSBAD VILLAGE DRIVE IN
LOCAL FACILITIES MANAGEMENT ZONE 2.
CASE NAME: BRIGHTON GARDENS
CASE NO: HDP 96-09
WHEREAS, Marriott Senior Living Services, Inc., “Developer”, has f
verified application with the City of Carlsbad regarding property owned by HSP El Ca
North, ‘Pnc., “Owner”, described as
Parcels 2 and 4 of Parcel Map No. 13206, in the City of
Carlsbad, County of San Diego, State of California, filed in the
Office of the County Recorder of San Diego County, March 14,
1984 as FileRage No. 84-092419 of Official Records; and
Parcel 3 of Parcel Map No. 13206, filed in the office of the
County Recorder of San Diego County, California, together
with a portion of lot 5 in Section 32, Township 11 South, Range
4 West, San Bernardino Meridian, according to the Official
Plat thereof, all being in the City of Carlsbad, County of San
Diego, State of California
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Hi
Development as shown on Exhibits “D”-“G” dated February 5, 1997, on file in the Car
Planning Department Hillside Development Permit HDP 96-09 as provided by Chapter
of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 5th day of February
consider said request; and

WHEREAS, at said hearing, upon hearing and considering all testimony ar
arguments, if any, of all persons desiring to be heard, said Commission considered all facto
relating to the Hillside Development Permit;
NOW, THEWEFORE, BE IT HEREBY RESOLVED by the Plannil,
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Plsu
Commission APPROVES a Hillside Development Permit Exclusion, HD:
09, based on the following findings and subject to the following conditions:
Findings:
1. That hillside conditions have been properly identified on the constraints map which ~
existing and proposed conditions and slope percentages.
2. That undevelopable areas of the project, i.e. slopes over 40%, have been pro
identified on the constraints map.
3. That the project is excluded from the requirements of the Hillside Develop:
Regulations as an area previously disturbed by authorized grading and as an ar
topographic change less than 15 feet in height and less than four thousand sq
feet in area, which is not part of the surrounding generalized slope.
Conditions:
1. The Planning Commission does hereby APPROVE a Hillside Development Permj
Exclusion for project entitled Brighton Gardens, Exhibits “D”-“G” dated Februay
5, 1997, on file in the Planning Department and incorporated by this referencc
subject to the conditions herein set forth. Staff is authorized and directed to make, c
require Developer to make, all corrections and modifications to the Hillsid
Development Permit document(s), as necessary, to make them internally consister
and in conformity with final action on the project. Development shall occc
substantially as shown in the approved Exhibits. Any proposed developmer
substantially different from this approval, shall require an amendment to thi
approval.
2. Approval of HDP 96-09 is subject to the approval of CUP 96-19, SDP 96-10 anc
SUP 96-06.
