CASE NAME: BRIGHTON GARDENS CASE NO.: SDP 96-10 WHEREAS, Marriott Senior Living Services, Inc., “Developer”, has fj verified application with the City of Carlsbad regarding property owned by HSP El Ca North, Inc., “Owner”, described as Parcels 2 and 4 of Parcel Map No. 13206, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, March 14, 1984 as Filepage No. 84-092419 of Official Records; and Parcel 3 of Parcel Map No. 13206, filed in the office of the County Recorder of San Diego County, Callifornia, together with a portion of lot 5 in Section 32, Township 11 South, Range 4 West, San Bernardino Meridian, according to the Official Plat thereof, all being in the City of Carlsbad, County of San Diego, State of California (“the Property”); and WHEREAS, said verified application constitutes; a request for a Site DeveloI Permit as shown on Exhibits “A”-“C” and “H”-“S” dated ]February 5, 1997, on file i Planning Department, Site Development Plan SDP 96-10 as provided by Chapter 21.06 c Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 5th day of February hold a duly noticed public hearing as prescribed by law to consider said request; and I ~ *.- ~ ... NOW, THEREFORE, BE IT HEREBY IRESOLVED by the Pla Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Corn APPROVES Site Development Permit, SDP 96-10 based on the follc findings and subject to the following conditions: Findings: 1. That all findings of CUP 96-1 9 are incorporated herein by reference. 2. That the requested use is properly related to the site, surroundings and environn settings, is consistent with the various elements and objectives of the General Plan not be detrimental to existing uses or to uses specifically permitted in the area in T the proposed use is to be located, and will not adversely impact the site, surroundir traffic circulation, in that the project will provide sufficient setbacks on all perims will incorporate an architectural theme that is consistent with surrounding uses will provide housing and related services for the senior segment of the comml The project will generate 480 Average Daily Trips (ADT) which is significant x mitigated by addition of a deceleration lane on El Camino Real. 3. That all yards, setbacks, walls, fences, landscaping, and other features necessary to 2 the requested use to existing or permitted future uses in the neighborhood wj provided and maintained, in that the project has an 80 foot front yard setback, a foot side yard setback, a 42 foot rear yard setback, amd fully landscaped court! and other open space areas. 5. That the street systems serving the proposed use will be adequate to properly hand traffic generated by the proposed use, in that the projlect is projected to generatc ADT which can be accommodated by El Camino IReal, a prime arterial wit1 addition of a deceleration lane which will reduce potential conflicts with thr traffic and traffic entering the site. ... The Planning Commission does hereby APPROVE th.e Site Development Plan f project entitled Brighton Gardens (Exhibits “A”-“C” and “H”-“S” dated Febru 1997) on file in the Planning Department and incorporated by this reference, subj the conditions herein set forth. Staff is authorized and directed to make, or rt Developer to make, all corrections and modification:; to the Site Development document(s), as necessary, to make them internally consistent and in conformity final action on the project. Development shall occur substantially as shown j approved Exhibits. Any proposed development substantially different from this app shall require an amendment to this approval. 2.
