HomeMy WebLinkAbout1997-02-05; Planning Commission; Resolution 4037c .- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 01 PLANNING COMMISSION RESOLUTION NO. 4037 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A SPECIAL USE PERMIT FOR AN 84,000 SQUARE FOOT PROFESSIONAL CARE FACILITY ON PROPERTY GENERALLY LOCATED EAST OF EL CAMINO REAL AND NORTH OF CARLSBAD VILLAGE DRIVE IN LOCAL FACILITIES MANAGEMENT ZONE 2 CASE NAME: BRIGHTON GARDENS CASE NO: SUP 96-06 WHEREAS, Marriott Senior Living Services, Inc., “Developer”, has f verified application with the City of Carlsbad regarding property owned by HSP EL Ci North, Inc., “Owner”, described as Parcels 2 and 4 of Parcel Map No. 13206, in the City of Carlsbad, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, March 14, 1984 as Filepage No. 84-092419 of Official Records; and Parcel 3 of Parcel Map No. 13206, filed in the office of the County Recorder of San Diego County, California, together with a portion of lot 5 in Section 32, Township 11 South, Range 4 West, San Bernardino Meridian, according to the Official Plat thereof, all being in the City of Carlsbad, County of San Diego, State of California (‘the Property,’); and WHEREAS, said verified application constitutes a request for a Special Permit as shown on Exhibits “A”-“Q” dated February 5,, 1997, on file in the Pla Department Special Use Permit SUP 96-06, and as provided in the El Camino Real Co Development Standards; and WHEREAS, the Planning Commission did on the 5th day of February hold a duly noticed public hearing as prescribed by law to consider said request; and ... 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 WHEREAS, at said public hearing, upon hearing and considering all test and arguments, if any, of all persons desiring to be heard, said Commission considered all j relating to the Special Use Permit; NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correc:t. B) That based on the evidence presented at the public hearing, the Comm APPROVES Special Use Permit SUP 96-06 based on the following finding subject to the following conditions: FindinEs: 1. That all findings of CUP 96-19 are incorporated herein by reference. 2. That the project has been designed with an Old California/Hispanic architec theme. 3. That the proposed project complies with the height :and setback standards oft Camino Real Corridor Standards by maintaining a height of 35 feet and a setback of 80 feet. Conditions: 1. The Planning Commission does hereby APPROVE the Special Use Permit fo project entitled Brighton Gardens Exhibits “A”-“Q” d.ated February 5, 1997, on f the Planning Department and incorporated by this reference, subject to the cond: herein set forth. Staff is authorized and directed to make, or require Developer to r all corrections and modifications to the Special Use Permit docwnent(s), as necessa make them internally consistent and in conformity with final action on the pr Development shall occur substantially as shown in the approved Exhibits.
