A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
ALLOW THE CONSTRUCTION OF 61 SINGLE FAMILY
HOMES ON PREVIOUSLY SUBDIVIDED LOTS WITHIN CT
COASTAL DEVELOPMENT PERMIT NO. CDP 96-07 TO
95-03, AND TO REVISE THE ARCHITECTURE SIZE, FLOOR
PLANS, AND LOCATION OF NINE APPROVED SECOND
DWELLING UNITS ON PROPERTY GENERALLY LOCATED
WEST OF HIDDEN VALLEY ROAD BETWEEN PALOMAR
AIRPORT ROAD AND CAMINO DE LAS ONDAS IN THE
ZONE 20 SPECIFIC PLAN AND LOCAL FACILITIES
MANAGEMENT ZONE.

WHEREAS, Ladwig Design Group, Inc., “Developer”, has filed a ve
application with the City of Carlsbad regarding property owned by UDC Homes, “Oc
described as
All that certain parcel of land delineated and designated as
“Description No. 1, 103.91 acres” on record of survey map no.
5715, filed in the office of the County Recorder of San Diego
County, December 19, 1960, being a portion of Lot “G” of
Rancho Agua Hedionda, according to map thereof No. 823,
filed in the Office of the County Recorder of San Diego
County, November 16, 1896, a portion of which lies within the
City of Carlsbad, all being in the County of San Diego, State of
California, also described as Parcel 2 in that certain certificate
of compliance recorded June 27,1996 as File No. 1996-0232496
of official records
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Cc
Development Permit as shown on Exhibits “A”-“X” dated February 5, 1997, on file i
Planning Department, CDP 96-07 as provided by Chapter 21.201.040 of the Carlsbad Mun
Code; and

WHEREAS, on July 12, 1996, the California Coastal Commission app
Coastal Development Permit 6-96-53, dated July 12, 1996. All conditions of CDP 6-96-:
applicable to this project; and
WHEREAS, the Planning Commission did, on the 5th day of February
hold a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testi
and arguments, if any, of all persons desiring to be heard, said Commission considered all f
relating to CDP 96-07.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Comm
APPROVES Coastal Development Permit, CDP 96-07, based on the follc
findings and subject to the following conditions:
Findings:
1. That the proposed development is in conformance with the Certified Local Cc
Program and all applicable policies in that the structural placement, second dwc
units, and architecture of single family residential structures are consistent wit
applicable R-1-7500-Q implementing zone standards.
2. The project is subject to and consistent with the Mello I1 LCP Segment Agricul
Overlay Zone in that it is required to offset the conversion of non-prime agricul
land to urban land uses through the payment of an agricultural mitigation fet
all sedimentation, erosion, and drainage measures were previously appr
through the issuance of a Coastal Development Permit for CT 95-03 bJ
California Coastal Commission.
Conditions:
1. The Planning Commission does hereby APPROVES the Coastal Development PN
for the project entitled Emerald Ridge West (Exhibits “A”-“X” dated Februa:
1997) on file in the Planning Department and incorporated by this reference, subjc
the conditions herein set forth. Staff is authorized and directed to make, or re
Developer to make, all corrections and modifications to the Coastal Development P

final action on the project. Development shall occm substantially as shown i
approved Exhibits. Any proposed development substantially different from this app
shall require an amendment to this approval.
2. Approval of CDP 96-07 is granted subject to approval of SDP 95-06(A) and HDI
06(A). CDP 96-07 is subject to all conditions contained in Planning Commi
Resolutions No. 4051 and 4052, for SDP 95-06(A) and HDP 95-06(A).
3. To offset the conversion of non-prime agricultural land to urban land uses pe
requirements of the Mello I1 Local Coastal Program, the applicant shall pri
payment of an agricultural mitigation fee, the amount of which shall not be less
$5,000 nor more than $10,000 for each net converted acre of non-prime agricul
land. The amount of the fee shall be determined by the City Council pric
approval of the final map or issuance of any building permit, whichever occurs
and shall be consistent with the provisions of Carlsbad's LCP.

Commission of the City of Carlsbad, California, held on the 5th day of February 1997, b
following vote, to wit:
