HomeMy WebLinkAbout1997-02-05; Planning Commission; Resolution 4056- c. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e 0 PLANNING COMMISSION RESOLUTION NO. 4056 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE ALLOW THE CONSTRUCTION OF 49 SINGLE FAMILY HOMES ON PREVIOUSLY SUBDIVIDED LOTS WITHIN CT 94- 1 1, AND TO REVISE THE ARCHITECTURE, SIZE, FLOOR PLANS AND LOCATION OF EIGHT APPROVED SECOND DWELLING UNITS ON PROPERTY GENERALLY LOCATED WEST OF HIDDEN VALLEY ROAD BETWEEN PALOMAR AIRPORT ROAD AND CAMINO DE LAS ONDAS IN THE ZONE 20 SPECIFIC PLAN AND LOCAL FACILITIES MANAGEMENT ZONE. CASE NAME: MAR VISTA CASE NO.: SDP 94- 1 O(A) WHEREAS, Ladwig Design Group, Inc./UDC Homes, “Developer”, has f verified application with the City of Carlsbad regarding property owned by McReynolds F; Trust, “Owner”, described as DEVELOPMENT PLAN AMENDMENT NO. SDP 94-10(A) TO Parcel C of Parcel Map 2949, in the City of Carlsbad, California, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, August 9,1974, as File 74-216632 of official records (“the Property”); and WHEREAS, said verified application constitutes a request for a Site Develor Permit Amendment as shown on Exhibits “A”-“X” dated February 5, 1997, on file j Planning Department, SDP 94-10(A), Mar Vista as provided by Chapter 21.06 of the Csu Municipal Code; and WHEREAS, the Planning Commission did, on the 5th day of February hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testi and arguments, if any, of all persons desiring to be heard, said Commission considered all f relating to the Site Development Plan. b 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1 27 28 0 0 WHEREAS, on January 3, 1996, the Planning Commission approved, SD 10, as described and conditioned in Planning Commission Resolution No. 3876. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Comm APPROVES Site Development Permit Amendment, SDP 94-10(A) based ( following findings and subject to the following conditions: Findings: 1. All findings of SDP 94-10 as stated in Planning Commission Resolution No. shall apply as findings of SDP 94-10(A). 2. That the Planning Director has determined that the project is exempt fion requirements of the California Environmental Quality Act (CEQA) per Section 15 1 the state CEQA Guidelines and will not have any adverse significant impact o environment. 3.- That the requested use is properly related to the site, surroundings and environn settings, is consistent with the various elements and objectives of the General Plan not be detrimental to existing uses or to uses specifically permitted in the area in 1 the proposed use is to be located, and will not adversely impact the site, surroundir traffic circulation, in that the single family units on previously subdivided lot compatible with surrounding single family development, separated from Poin Park, and designed in accordance with Specific Plan 203 and Hillside Develop Ordinance architectural standards to ensure architectural variety and ex1 colors and textures which blend with the surrounding natural landscape. 4. That the site for the intended use is adequate in size and shape to accommodate the u that the four floor plans for single family units can be accommodated withil building envelope of each previously subdivided lot as shown on Exhibits “A” dated February 5,1997. 5. That all yards, setbacks, walls, fences, landscaping, and other features necessary to : the requested use to existing or permitted future uses in the neighborhood w provided and maintained, in that the placement of single family structures adhf all setback requirements of the R-1 One Family Residential Zone as well as tE fire suppression and habitat preservation setback required by CT 94-11 (Mar Subdivision Map), and architectural elevations adhere to the architec standards of the Zone 20 SP 203 and Hillside Development Ordin PC RES0 NO. 4056 -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e e Additionally, uniform fencing around the perimeter of each lot which is cons: in color and texture with the surrounding natural landscape will aesthet enhance the development. 6. That the street systems serving the proposed use is adequate to properly handle all I generated by the proposed use, in that the 49 single family units and 8 second dw units on previously subdivided lots would not generate additional traffic br that analyzed and approved as adequate by CT 94-11 (Mar Vista Subdivision il Planning; Conditions: 1. The Planning Commission does hereby APPROVE the Site Development Amendment for the project entitled Mar Vista (Exhibits “A”-“X” dated Februa 1997 which supersedes Exhibits “A”, “E” and “F,” dated January 3, 1996) on j the Planning Department and incorporated by this reference, subject to the cond herein set forth. Staff is authorized and directed to make, or require Developer to 1 all corrections and modifications to the Site Development Plan document(: necessary, to make them internally consistent and in conformity with final action c project. Approval of SDP 94-10(A) is granted subject to approval of HDP 94-09(A) and 96-08. SDP 94-10(A) is subject to all conditions contained in Planning Commi Resolution No. 3875 for SDP 94-10 except Condition No. 50 which is amende Condition No. 3 below, and Planning Commission Resolutions No. 4057 and 1 for HDP 94-09(A) and CDP 96-08. 3. Prior to approval of the final map for any phase of this project, or where a m not being processed, prior to the issuance of building permits for any lots or 1 the developer shall enter into an agreement with the City to deed restrict 8 se dwelling units (including: Lots 8,18,24,27,32,35,44, and 50) and the purchasc Affordable Housing Credit in Villa Loma, as appropriate, in accordance wit1 requirements set forth in Chapter 21.85 of the Carlsbad Municipal Code, the 20 Specific Plan, and City Council Policies 57 and 58 dated September 12, Prior to City Council approval, the developer shall submit a signed Afforc Housing Agreement to the Housing and Redevelopment Director. The recc Affordable Housing Agreement shall be binding on all future owners and succe; in interest. 4. Building footprints shown on Exhibits “A - C” shall represent the preferred plan except on Lots 21 and 31 which shall be developed with the approved s story structure (Plan 1) only and Lots 8,18,24,27,32,35, 44, and 50 which shi developed with second dwelling units (Plan 4) only unless an offsite inclusicl housing option is approved in accordance with Condition No. 3 above. Prior to the issuance of building permits for model units or the first phase of 1 whichever occurs first, the Planning Director shall require that the approved P floor plan with the second dwelling unit shall be included in the model units or phase of units to be constructed. Fire Conditions: 6, Prior to occupancy of buildings, all wildland fuel mitigation activities must be corn and the condition of all vegetation within 60 feet of structures found to be in confom with an approved wildland fuel management plan. 7.
