CDP 96-08 TO 94- 1 1, AND TO REVISE THE ARCHITECTURE, SIZE, FLOOR PLANS AND LOCATION OF EIGHT APPROVED SECOND DWELLING UNITS ON PROPERTY GENERALLY LOCATED WEST OF HIDDEN VALLEY ROAD BETWEEN PALOMAR AIRPORT ROAD AND CAMINO DE LAS ONDAS IN THE ZONE 20 SPECIFIC PLAN AND LOCAL FACILITIES MANAGEMENT ZONE. CASE NAME: MAR VISTA CASE NO.: CDP 96-08 WHEREAS, Ladwig Design Group, Inc./UDC Homes, “Developer”, has f verified application with the City of Carlsbad regarding property owned by McReynolds F: Trust, “Owner”, described as Parcel C of Parcel Map 2949, in the City of Carlsbad, California, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County, August 9,1974, as File 74-216632 of official records (“the Property”); and WHEREAS, said verified application constitutes a request for a Cc Development Permit as shown on Exhibits “A”-“X” dated February 5, 1997, on file i Planning Department, CDP 96-08 as provided by Chapter 21.201.040 of the Carlsbad Mun Code; and WHEREAS, on July 12, 1996, the California Coastal Commission appr Coastal Development Permit 6-96-46. All conditions of CDP 6-96-46 are applicable tc project; and WHEREAS, the Planning Commission did, on the 5th day of February hold a duly noticed public hearing as prescribed by law to consider said request; and & ’i 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 WHEREAS, at said public hearing, upon hearing and considering all testi and arguments, if any, of all persons desiring to be heard, said Commission considered all f relating to CDP 96-08. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Comm APPROVES Coastal Development Permit, CDP 96-08, based on the follc findings and subject to the following conditions: Findinps: 1. That the proposed development is in conformance with the Certified Local Cc Program and all applicable policies in that the structural placement, second dwc units, and architecture of single family residential structures are consistent wit applicable R-1-7500-Q and Hillside Development Ordinance implementing standards. 2. The project is subject to and consistent with the Mello I1 LCP Segment Agricul Overlay Zone and Coastal Resource Protection Overlay Zoning in that it is reql to offset the conversion of non-prime agricultural land to urban land uses thrl the payment of an agricultural mitigation fee and all sedimentation, erosion drainage measures were previously approved through the issuance of a Co Development Permit for CT 94-11 by the California Coastal Commission. Conditions: 1. The Planning Commission does hereby APPROVES the Coastal Development PC for the project entitled Mar Vista (Exhibits “A”-“X” dated February 5, 1997) on fi the Planning Department and incorporated by this reference, subject to the condi herein set forth. Staff is authorized and directed to make, or require Developer to 11 all corrections and modifications to the Coastal Development Permit document(s necessary, to make them internally consistent and in conformity with final action 01 project. Development shall occur substantially as shown in the approved Exhibits. proposed development substantially different from this approval, shall requirl amendment to this approval. 2. Approval of CDP 96-08 is granted subject to approval of SDP 94-10(A) and HDP 09(A). To offset the conversion of non-prime agricultural land to urban land uses pe requirements of the Mello I1 Local Coastal Program, the applicant shall prc payment of an agricultural mitigation fee, the amount of which shall not be less $5,000 nor more than $10,000 for each net converted acre of non-prime agricul land. The amount of the fee shall be determined by the City Council pric approval of the final map or issuance of any building permit and shall be consi with the provisions of Carlsbad's LCP.
