CASE NAME: SOUTH CARLSBAD LIBRARY CASE NO.: CDP 97-01 WHEREAS, the City of Carlsbad, “Developer”, has filed a verified applic with the City of Carlsbad regarding property owned by the City of Carlsbad, ‘‘Ch described as COASTAL DEVELOPMENT PERMIT NO. CDP 97-01 TO Parcel 2 of Parcel Map No 16044, filed on April 5, 1990 in the Office of the County Recorder, City of Carlsbad, County of San Diego, State of California (“the Property”); and WHEREAS, said verified application constitutes a request for a Cc Development Permit as shown on Exhibits “A”-“G” dated March 5, 1997, on file i Planning Department, South Carlsbad Library (CDP 97-01) as provided by C1 21.201.040 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 5th day of March 1997,l duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering a11 testi: and arguments, if any, of all persons desiring to be heard, said Commission considered all fi relating to CDP 97-01. B) That based on the evidence presented at the public hearing, the Comm APPROVES Coastal Development Permit CDP 97-01, based on the follc findings and subject to the following conditions: Findings: 1. That the proposed development is in conformance with the Certified Local CI Program and all applicable policies in that no agricultural lands, envirsnmel sensitive habitats, shoreline access, coastal erosion or visual panoramas are lo on the library site or involved with the project and the provision of the libray associated services provides a visitor-serving use. 2. That the development is in conformity with the public access and public recrt policies of Chapter 3 of the Coastal Act, in that no public beach access is requirl the site since it lies approximately three (3) miles from the coast, approximate[ (I) mile from Batiquitos Lagoon and no coastal or inland water areas exist I near the site. Conditions: 1. The Planning Commission does hereby APPROVE the Coastal Development Perm the project entitled South Carlsbad Library (Exhibits “A”-“G” dated March 5, : on file in the Planning Department and incorporated by this reference, subject t’ conditions herein set forth.) Staff is authorized and directed to make, or re Developer to make, all corrections and modifications to the Coastal Develop Permit document(s), as necessary, to make them internally consistent and in confo with final action on the project. Development shall occur substantially as shown i approved Exhibits. Any proposed development substantially different from this app~ shall require an amendment to this approval. 2.
