CASE NAME: PRICE CLUB PROPERTY ADJUSTMENT CASE NO.: SDP 90-05(B) WHEREAS, Carl Karcher Enterprises, “Developer”, has filed a vc application with the City of Carlsbad regarding property owned by The Price Com “Owner”, described as DEVELOPMENT PLAN AMENDMENT NO. SDP 90-05 (B) TO A portion of Parcel 2 of Parcel Map No. 17542 as recorded on June 27,1995 in San Diego County, File No. 1995-0267703 (“the Property”); and WHEREAS, said verified application constitutes a request for a Site Develor Plan Approval Amendment as shown on Exhibit “X” dated February 19, 1997, on file j Planning Department, SDP 90-05(B) as provided by Chapter 21.06 of the Carlsbad Mun Code; and WHEREAS, the Planning Commission did, on the 19th day of February the 5th day of March 1997, and the 19th day of March 1997, hold a duly noticed public ht as prescribed by law to consider said request; and WHEREAS, at said public hearing, yon hearing and considering all testil and arguments, if any, of all persons desiring to be heard, said Commission considered all f: relating to the Site Development Plan; and WHEREAS, on April 3, 1996, the Planning Commission approved SDI ~ 05(A) as described and conditioned in Planning Commission Resolution No. 3913. 0 0 a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Pls Commission APPROVES Site Development Permit Amendment, SDP 90-1 based on the following findings and subject to the following conditions: Findings: 1. That the removal of the subject property from the Price Club SDP wil adversely impact the Price Club existing use or entitlements. Furthermorc original Site Development Plan final map for the Price Club as contain1 Resolutions No. 3209 and 3913 are still valid. 2. That the Price Club and Carl’s Jr. Applicant have mutually agreed to a sale c subject property for use with the Carl’s Jr. project. 3. That the use of the subject property will be beneficial to the Carl’s Jr. project ’ not negatively affecting Price Club. Conditions: 1. The Planning Commission does hereby APPROVE the Site Development Amendment SDP 90-05(B) for the project entitled Price Club Property Adjusl (Exhibit “X” dated February 19, 1997, on file in the Planning Departmen incorporated by this reference), subject to the conditions herein set forth. St. authorized and directed to make, or require Developer to make, all correction: modifications to the Site Development Plan document(s), as necessary, to make internally consistent and in conformity with final action on the project. Develop shall occur substantially as shown in the approved Exhibits. Any proposed develop substantially different from this approval, shall require an amendment to this approv; 2. Approval of SDP 90-05(B) is granted subject to the approval of SDP 96-05. 3. Prior to approval of the building permits associated with SDP 96-05 (the C Jr./Green Burrito Drive-Thru Restaurant project), the Developer shall re approval of a Coastal Development Permit issued by the California Coastal Commj that substantially conforms to this approval. A signed copy of the Coastal Develop Permit must be submitted to the Planning Director. If the approval is substan different, an amendment to SDP 90-05(B) shall be required. 4. Internal directional and traffic control signs shall be provided on both the 1 Club site and the Carl’s Jr. site.
