A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
ALLOW THE CONSTRUCTION OF 93 SINGLE FAMILY
HOMES ON PREVIOUSLY SUBDIVIDED LOTS WITHIN CT
COASTAL DEVELOPMENT PERMIT NO. CDP 97-02 TO
92-02(A), AND TO ALLOW MINOR LOT GRADING
ASSOCIATED WITH THE EXPANSION OF THE PAD AREAS
OF SOME OF THE APPROVED SINGLE FAMILY LOTS ON
PROPERTY GENERALLY LOCATED WEST OF AVIARA
PARKWAY BETWEEN CAMINO DE LAS ONDAS AND
PALOMAR AIRPORT ROAD IN LOCAL FACILITIES
MANAGEMENT ZONE 20.
CASE NAME: SAMBI SEASIDE HEIGHTS
CASE NO.: CDP 97-02
WHEREAS, Kaufman and Broad of San Diego, Inc, “Developer”, has fi
verified application with the City of Carlsbad regarding property owned by Sambi Se:
Heights, LLC, “Owner”, described as
Lots 37-111 and lots 120-137 of map 13378 of Carlsbad Tract
92-02
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Cc
Development Permit as shown on Exhibits “A”-“HH” dated April 16, 1997, on file il
Planning Department, CDP 97-02 as provided by Chapter 2 1.20 1.040 of the Carlsbad Muni
Code; and
WHEREAS, on March 8, 1995, the California Coastal Commission appr
Coastal Development Permit 6-94-13 1, dated March 8, 1995. All conditions of CDP 6-9L
are applicable to this project; and
WHEREAS, the Planning Commission did, on the 16th day of April 1997, h
1 duly noticed public hearing as prescribed by law to consider said request; and

WHEREAS, at said public hearing, upon hearing and considering all testi
and arguments, if any, of all persons desiring to be heard, said Commission considered all f
relating to CDP 97-02.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commi
APPROVES Coastal Development Permit CDP 97-02, based on the folk
findings and subject to the following conditions:
Findings:
1. That the proposed development is in conformance with the Certified Local Ct
Program and all applicable policies in that (1) the structural placement
architecture of the single family residential structures is consistent with
applicable R-1-7500 zone development standards (implementing zone for
project); (2) the proposed minor lot grading (i.e. encroachment into exi
manufactured slopes of equal to or greater than 25%) for purposes of increasin
rear and side yard pad areas for some of the lots is consistent with the If
Preservation policies of the Mello I1 LCP because these existing manufacl
slopes are not subject to such policies; (3) no sensitive coastal resources wi
impacted by the proposed minor grading; and, (4) adequate drainage and erl
control measures have been incorporated into the project.
2. This project is a part of a larger project (CT 92-02(A)) which has already
issued a Coastal Development Permit by the California Coastal Commission b
upon findings of consistency with the Mello I1 Coastal Resource Protection Ovc
Zone and the Coastal Agricultural Overlay Zone. All conditions of the exi:
approved Coastal Development Permit for CT 92-02(A) have been satisfied
receipt of Federal and State Resource Agency permits, purchase of mitig:
credits from the Carlsbad Highlands Mitigation Bank and payment of
Agricultural Conversion Mitigation Fee to the California Coastal Conservancy),
Conditions:
Planning:
1. The Planning Commission does hereby APPROVE the Coastal Development Perm:
the project entitled Sambi Seaside Heights (Exhibit(s) “A”-“HH” dated April 16, 3
on file in the Planning Department and incorporated by this reference, subject tc
conditions herein set forth.) Staff is authorized and directed to make, or rei

Permit docurnent(s), as necessary, to make them internally consistent and in confc
with final action on the project. Development shall occur substantially as shown
approved Exhibits. Any proposed development substantially different from this app
shall require an amendment to this approval.
2. This project is approved subject to the condition that the sideyard fencing whic
is located between lots 46 and 47 and the public trail be constructed of mason]
block with a stucco finish. These walls shall be constructed prior to the issuanc
of certificates of occupancy for lots 46 and 47.
Engineering:
3. The typical drainage system shown on Sheet 1 of the plot plans has been reviewed 1
the City Engineer and is approved subject to the following conditions:
a. Existing typical lot grading standard GS-15 shall be incorporated for all lo1
except as shown on alternate section DID on Sheet 1 of the plot plans for th
project.
b. The 15 lots identified in the above mentioned alternative drainage design sha
have: Deepened Footings, PVC yard drains, retaining wall drainage system
and shall comply with specific recommendations from the project's Soi
Engineer.
c. Any changes to the alternative drainage design shall be approved by the Cit
Engineer prior to individual unit construction prior to pad certification by th
project Engineer.
4. The fence plan and grading plan shall comply with the City of Carlsbad Engineerin
sight distance corridor standards.
5. All applicable conditions of CT 92-02 and CT 92-02(A) are incorporated b
reference to this approval.
Fire:
6. Prior to the issuance of building permits, complete building plans shall be approve
by the Fire Department.
7. Additional on-site public water mains and fire hydrants are required, as shown on th
approved improvement plans for CT 92-02(A).
8. Applicant shall submit a site plan to the Fire Department for approval, which depict
location of required, proposed and existing public water mains and fire hydrants. Ths
plan should include off-site fire hydrants within 200 feet of the project, as shown 01
the approved improvement plans for CT 92-02(A).

9. Applicant shall submit a site plan depicting emergency access routes, driveways ar
traffic circulation for Fire Department approval, as shown on the approvc
improvement plans for CT 92-02(A).
10. An all weather, unobstructed access road suitable for emergency service vehicles sh
be provided and maintained during construction. When in the opinion of the Fi
Chief, the access road has become unserviceable due to inclement weather or 0th
reasons, he may, in the interest of public safety, require that construction operatio
cease until the condition is corrected.
11. All required water mains, fire hydrants and appurtenances shall be operational befo.

12. Native vegetation which presents a fire hazard to structures shall be modified (
removed in accordance with the specifications contained in the City of Carlsb:
Landscape Guidelines Manual, as shown on the approved landscape plans for C
92-02(A), and as approved by the Fire Department.
13. The applicant shall provide a street map which conforms to the followir
requirements: A 400 scale photo-reduction mylar, depicting proposed improvemen
and at least two existing intersections or streets. The map shall also clearly depi
street centerlines, hydrant locations and street names.
