HomeMy WebLinkAbout1997-05-21; Planning Commission; Resolution 4094P 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 PLANNING COMMISSION RESOLUTION NO. 4094 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO ALL SIX SEGMENTS OF THE CARLSBAD LOCAL COASTAL PROGRAM TO MAKE THE ZONING CODE AND THE LOCAL COASTAL PROGRAM CONSISTENT WITH REGARD TO CHILD DAY CARE FACILITIES CASE NAME: CHILD CARE ORDINANCE CASE NO: LCPA 97-03 WHEREAS, the City is adding Chapter 21.83 to Title 21 of the Carl Municipal Code and revising other sections of Title 21 with regard to the child day care facil WHEREAS, the Zoning Ordinance is the implementing ordinance for the C Local Coastal Program; WHEREAS, California state law requires that amendments to the implemer ordinance also require an amendment to the Local Coastal Program to ensure consist between the two documents; WHEREAS, a verified application for an amendment to the Local Co Program has been filed with the Planning Department; and, WHEREAS, said verified application constitutes a request for a Local Co; Program Amendment as shown on Exhibit “X” dated May 7, 1997, attached to Plan Commission Resolution No. 4093, as provided in Public Resources Code Section 30574 Article 15 of Subchapter 8, Chapter 2, Division 5.5 of Title 14 of the California Cod Regulations of the California Coastal Commission Administrative Regulations; and WHEREAS, the Planning Commission did on the 7th day of May 1997, and ~ 21st day of May 1997, hold a duly noticed public hearing as prescribed by law to consider ~ request; and ... + , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 WHEREAS, at said public hearing, upon hearing and considering all testin and arguments, if any, of all persons desiring to be heard, said Commission considered all fa relating to the Local Coastal Program Amendment. WHEREAS, State Coastal Guidelines requires a six week public review perio any amendment to the Local Coastal Program. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plan Commission of the City of Carlsbad, as follows: A) That the foregoing recitations are true and correct. B) At the end of the State mandated six week review period, starting on Apri 1997 and ending on May 29, 1997, staff shall present to the City Count summary of the comments received. C) That based on the evidence presented at the public hearing, the Commis RECOMMENDS APPROVAL of LCPA 97-03 based on the following findi and subject to the following conditions: Findinm: 1. That the proposed Local Coastal Program Amendment is consistent with all applic policies of the Mello I, Mello 11, Agua Hedionda, East Batiquitos/Hunt, and 1 Batiquitos/Sammis segments of the Carlsbad Local Coastal Program, in that proposed amendment is limited in its nature and will not change existing regulati prohibiting or restricting development on sensitive slopes, bluff tops, or agricultl lands, and will not change any requirements for vista pointshiew corridors. 2.
