CASENAME: AVIARA LOT 308/AZURE COVE CASE NO: ZC 97-03 WHEREAS, Aviara Land Associates and Brookfield Carlsbad, “Devel has filed a verified application with the City of Carlsbad regarding property owned by A Land Associates and Brookfield Carlsbad, “Owner”, described as ANNEXATION All of Carlsbad Tract No 89-19, according to Map No. 12902, filed December 11,1991 in the Office of the County Recorder, County of San Diego, State of California (“the Property”); and WHEREAS, said application constitutes a request for a Zone Change as sho Exhibits “2‘ dated May 21, 1997, attached, Zone Change ZC 97-03 as provided by C1 21.52 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 21st day of May, 1997,l duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all test1 and arguments, if any, of all persons desiring to be heard, said Commission considered all f relating to the Zone Change; and ~ NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1z Commission as follows: ... 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 e A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Comm RECOMMENDS APPROVAL of Zone Change, ZC 97-03, based o following findings: Findings: 1. That the proposed Zone Change from R-1-7,500-Q and 0-S to P-C is consistent w goals and policies of the various elements of the General Plan, in that it contint provide a balanced mix of land uses within Aviara Master Plan and pra consistency with the Citywide mechanisms for master plan implementation. 2. That the Zone Change will provide consistency between the General Plan and Zon mandated by California State law and the City of Carlsbad General Plan Lanc Element, in that the property is being annexed into the Aviara Master Plan anc zoning is used for implementation of master plans in the City. Conditions: 1. The Planning Commission does hereby RECOMMEND APPROVAL of the E Plan Amendment for the project entitled Aviara Lot 308/Azure Cove Annexation 97-03 (Exhibit “Z” dated May 21, 1997, attached and incorporated by this refe. subject to the conditions herein set forth.) Staff is authorized and directed to mal require Developer(s) to make, all corrections and modifications to the Master Amendment documents as necessary, to make them internally consistent a~ conformity with final action on the project. Development shall occur substantia shown in the approved Exhibits. Any proposed development substantially different this approval, shall require an amendment to this approval. 2. The Developers shall comply with all applicable provisions of federal, state, and ordinances in effect at the time of building permit issuance. 3. Approval of ZC 97-03 is granted subject to the approval of MP 177(S), GPA 96-01 LCPA 96-13. ZC 97-03 is subject to all conditions contained in Planning Comm Resolutions No. 4096, 4097 and 4098 for MP 177(S), GPA 96-06 and LCPA ! respectively. ... ... ... ...
