A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO THE LAND USE
ELEMENT OF THE GENERAL PLAN, CHANGING AN 18.3
ACRE PARCEL FROM NEIGHBORHOOD COMMERCIAL TO
RESIDENTIAL MEDIUM DENSITY ON PROPERTY
GENERALLY LOCATED WITHIN THE AVIARA MASTER
PLAN, NORTH OF AVIARA PARKWAY, WEST AND EAST
OF BLACK RAIL COURT IN LOCAL FACILITIES
MANAGEMENT ZONE 19.

WHEREAS, Aviara Land Associates, “Developer”, has filed a ve
application with the City of Carlsbad regarding property owned by Aviara Land Assoc
“Owner”, described as
A portion of Section 22,26, 27, 28, 33, and 34 in Township 12
South, Range 4 West, in the City of Carlsbad, County of San
Diego, State of California
(“the Property”); and
WHEREAS, said verified application constitutes a request for a General
Amendment as shown on Exhibit “Y” dated June 4,1997, attached, General Plan Amend
(GPA 96-02), as provided in Chapter 21.52 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 4th day of June 1997, k
duly noticed public hearing as prescribed by law to consider said request;
WHEREAS, at said public hearing, upon hearing and considering all testi
and arguments, if any, of all persons desiring to be heard, said Commission considered all f
relating to the General Plan Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla
Commission of the City of Carlsbad, as follows:

A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Pla
Commission RECOMMENDS APPROVAL of General Plan Amendment
96-02, exchanging neighborhood commercial and residential medium de
land use designations, as shown on Exhibit “Y” dated June 4, 1997. St
authorized and directed to make, or require Developer to make, all nece
corrections and modifications to the General Plan Amendment documen
necessary, to make them internally consistent and in conformity with final z
on the project, based on the following findings:
Findincs:
1. The proposed amendment to the land use element is consistent with goals
objectives of the various elements of the General Plan in that it still provides
balance of land uses and does not preclude the provision of future housing nee
the southwest quadrant.
2. The proposed amendment to the land use element is compatible with adjacent
since the project site is surrounded by residential and open space uses.
3. The proposed amendment to the land use element is compatible with the under1
Planned Community zoning in that it continues to provide the necessary balan
land uses within the Aviara Master Plan.
Conditions:
1. The Planning Commission does hereby RECOMMEND APPROVAL of the Ge.
Plan Amendment for the project entitled Aviara Planning Area 23 - GPA 9
(Exhibit “Y” dated June 4,1997, attached and incorporated by this reference), subje
the conditions herein set forth. Staff is authorized and directed to make, or re(
Developers to make, all corrections and modifications to the General Plan Amend:
documents as necessary, to make them internally consistent and in conformity with
action on the project. Development shall occur substantially as shown in the appr
Exhibits. Any proposed development substantially different from this approval,
require an amendment to this approval.
2. Approval of GPA 96-02 is granted subject to the approval of MP 177(R) and LCPA
02. GPA 96-02 is subject to all conditions contained in Planning Commis
Resolutions No. 4114 and 4116 for MP 177(R) and LCPA 96-02, respectively.
