A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
PLANNED DEVELOPMENT PERMIT TO SUBDIVIDE 8.52
ACRES INTO TWENTY SIX SINGLE FAMILY LOTS THREE
LOTS TO PROVIDE LEGAL ACCESS TO ADJACENT
PROPERTIES AND FOUR OPEN SPACE LOTS FOR A TOTAL
OF 33 LOTS ON PROPERTY GENERALLY LOCATED ON
THE NORTH SIDE OF CARLSBAD VILLAGE DRIVE AT
DONNA DRIVE IN LOCAL FACILITIES MANAGEMENT

WHEREAS, Pacific View LTD, “Developer”, has filed a verified application with the C
Carlsbad regarding property owned by Daniel W. Ryan, “Owner”, described as
A Portion of the northwest quarter of the southwest quarter of
Section 32, Township 11 south, Range 4 west, San Bernardino
Base and Meridian, in the City of Carlsbad, County of San
Diego, State of California
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Condomj
Permit as shown on Exhibits “A”-“O” dated May 21, 1997, on file in the Planning Depart
Pacific View Estates - PUD 96-03 as provided by Chapter 21.45 of the Carlsbad Mun
Code; and
WHEREAS, the Planning Commission did, on the 21st day of May 1997, 4
June 1997, and the 18th of June 1997, hold a duly noticed public hearing as prescribed b
to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testi
~ and arguments, if any, of persons desiring to be heard, said Commission considered all f2
relating to the Condominium Permit.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Comm:
APPROVES Condominium Permit PUD 96-03, based on the following fin
and subject to the following conditions:
Findines:
I. That the granting of this permit will not adversely affect and will be consistent
Chapter 21.45 of Title 21, the General Plan, applicable specific plans, master plans
all adopted plans of the City and other governmental agencies, in that the pr
complies with all City plans, policies, standards and guidelines and is simil

2. That the proposed use at the particular location is necessary and desirable to prov

4. That the proposed Planned Development Permit meets all of the minimum develop1
standards set forth in Chapter 21.45.090, the design criteria set forth in Section 21.45.

Guidelines Manual in that compatible lot sizes, compatible architecture, adeq
resident and guest parking, recreational amenities, public street improvements

5. That the proposed project is designed to be sensitive to and blend in with the nai
topography of the site, and maintains and enhances significant natural resources on
site, in that the residential lots are designed to step down the hillside, the prc
design includes varying roof line orientations and a variety of building matel
compatible with developments in the area; the project complies with all smal
architectural guidelines; slope grading is designed with natural contouring
undulations; and, adequate landscaping is provided to soften slopes.
6. That the proposed project’s design and density of the developed portion of the si1

7. That the project’s circulation system is designed to be efficient and well-integrated
