HomeMy WebLinkAbout1997-06-18; Planning Commission; Resolution 4102- b 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 PLANNING COMMISSION RESOLUTION NO. 4102 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A HILLSIDE DEVELOPMENT PERMIT TO SUBDIVIDE 8.52 ACRES INTO TWENTY SIX SINGLE FAMILY LOTS THREE LOTS TO PROVIDE LEGAL ACCESS TO ADJACENT PROPERTIES AND FOUR OPEN SPACE LOTS FOR A TOTAL OF 33 LOTS ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF CARLSBAD VILLAGE DRIVE AT DONNA DRIVE IN LOCAL FACILITIES MANAGEMENT ZONE 1. CASE NAME: PACIFIC VIEW ESTATES CASE NO: HDP 96-03 WHEREAS, Pacific View LTD, “Developer”, has filed a verified application with the C Carlsbad regarding property owned by Daniel W. Ryan, “Owner”, described as A Portion of the northwest quarter of the southwest quarter of Section 32, Township 11 south, Range 4 west, San Bernardino Base and Meridian, in the City of Carlsbad, County of San Diego, State of California (“the Property”); and WHEREAS, said verified application constitutes a request for a Hi Development Permit as shown on Exhibits “A”-“O” dated May 21,1997, on file in the C~I Planning Department (Pacific View Estates - HDP 96-03) as provided by Chapter 21.95 Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 21st day of May 1997, 4 June 1997, and the 18th of June 1997, consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimon; arguments, if any, of all persons desiring to be heard, said Commission considered all fi relating to the Hillside Development Permit. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 e NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1: Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Comm APPROVES Hillside Development Permit, HDP 96-03, based on the folll findings and subject to the following conditions: FindinEs: 1. That hillside conditions have been properly identified on the constraints map which existing and proposed conditions and slope percentages. 2. That undevelopable areas of the project, i.e. slopes over 40%, have been prc identified on the constraints map. 3. That the development proposal is consistent with the intent, purpose, and requireme the Hillside Ordinance, Chapter 21.95, in that the project has been designed natural contour grading and disturbance of the hillside and will be compatiblr surrounding developments. The project has been designed with building pad step-down the project site to reduce visual impacts of the project. 4. That the proposed development or grading will not occur in the undevelopable portic the site pursuant to provisions of Section 21.53.230 of the Carlsbad Municipal COI that no development is proposed on the 40-percent or greater slopes on thl except for the grading of existing manufactured slopes which were created b development of Carlsbad Village Drive and Wintergreen Drive as pern pursuant to Section 21.95.090 of the Carlsbad Municipal Code for areas previ disturbed by authorized grading. Further, the identified impacts to the existing quality disturbed coastal sage scrub will be mitigated pursuant to ai requirements. 5. That the project design substantially conforms to the intent of the concepts illustral the Hillside Development Guidelines Manual, in that the project grading amounl within the acceptable range under (8,000 cubic yards per acre), the project has designed with building pads which step-down the hillside, the site is contour gl and includes a variety of slope directions and undulation, and slopes have designed with landscape screening to soften the visual impacts of the grading. 6. That the project design and lot configuration minimizes disturbance of hillside lanc that the amount of grading is limited to that required to create streets, building for residential units and development amenities, and the proposed amoul grading (7,460 cu yds per acre) is within the acceptable range for a hillside lot. ... The Planning Commission does hereby APPROVE the Hillside Development Pen project entitled Pacific View Estates, Exhibits “A”-“O” dated May 21, 1997, on the Planning Department and incorporated by this reference, subject to the con( herein set forth.
