CASE NAME: DENS0 - HAWK PROJECT CASE NO.: CDP 97-09 WHEREAS, Koll Real Estate Group, “Developer”, has filed a ver application with the City of Carlsbad regarding property owned by the Carltas Comp “Owner”, described as COASTAL DEVELOPMENT PERMIT NO. CDP 97-09 FOR A A portion of Lot 7 of Carlsbad Tract No. 94-09, Carlsbad Ranch Unit 1 as per Map No. 13357 filed September 11,1996, in the Office of the County Recorder as file No. 1996-0463214 in the City of Carlsbad, County of San Diego, State of California. (“the Property”); and WHEREAS, said verified application constitutes a request for a Co Development Permit as shown on Exhibit(s) “A” - “F” dated June 18, 1997, on file in Planning Department, CDP 97-09 as provided by Chapter 2 1.20 1.040 of the Carlsbad Munic Code; and WHEREAS, the Planning Commission did, on the 18th day of June 1997, hc duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testim and arguments, if any, of all persons desiring to be heard, said Commission considered all fac relating to CDP 97-09. c -. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e a NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plal Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commi APPROVES Coastal Development Permit CDP 97-09, based on the follo findings and subject to the following conditions: Findings: 1. That the proposed development is in conformance with the Certified Local Co Program and all applicable policies in that the project is in compliance with relevant policies of the Mello I1 Segment of the Local Coastal Program, Carlsbad Ranch Specific Plan which serves as partial implementation for the il I1 Segment for the project site, and the Coastal Resource Protection Overlay Zor 2. The project complies with the requirements of the Coastal Resource Protec Overlay Zone as the project site has been previously graded pursuant to the Ma Tentative Map (CT 94-09) for the Carlsbad Ranch. No sensitive vegetation exist the project site. Drainage facilities to remove pollutants from site runoff are provided. The time limitations on grading in the Coastal Zone have been applie a condition of this permit. Conditions: 1. The Planning Commission does hereby APPROVE the Coastal Development Pemi the project entitled CDP 97-09 (Exhibit(s) “A” - “F” dated June 18, 1997 on file ir Planning Department and incorporated by this reference, subject to the conditions he set forth.) Staff is authorized and directed to make, or require Developer to make corrections and modifications to the Coastal Development Permit document(s) necessary, to make them internally consistent and in conformity with final action on project. Development shall occur substantially as shown in the approved Exhibits. , proposed development substantially different from this approval, shall require amendment to this approval. 2. Building permits shall be issued for this project within two (2) years of approval or this coastal development permit will expire unless extended per Section 21.201.210 of the Zoning Ordinance. 3. Approval of CDP 97-09 is granted subject to the approval of SDP 97-05. CDP 97-09 is granted subject to all conditions contained in the Planning Commission Resolution for SDP 97-05. 4. All grading activity shall be prohibited between October 1st and April 1st of any year, or as otherwise allowed by the Mello TI Local Coastal Plan.
