CASE NAME: PILGRIM UNITED CHURCH OF CHRIST CASE NO.: CUP 85(B)xl WHEREAS, Pilgrim United Church of Christ , “Developer”, has filed a vc application with the City of Carlsbad regarding property owned by Pilgrim United Chu~ Christ, “Owner”, described as Lot 24 of Map No. 4165, Village Homes, Unit No. 2, in the City of Carlsbad, County of San Diego, filed in the office of the County Recorder on May 5,1959. (“the Property”); and WHEREAS, said verified application constitutes a request for a Condition2 Permit Extension as shown on Exhibit “A’ dated February 5, 1992, on file in the Car Planning Department (CUP 85(B)x1), as provided by the conditions of approval of CUP 1 and Chapter 21.42 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 2nd day of July 1997, ar 16th day of July 1997, hold a duly noticed public hearing as prescribed by law to considel request; and WHEREAS, at said public hearing, upon hearing and considering all testi~ and arguments, if any, of all persons desiring to be heard, said Commission considered all fi relating to CUP 85(B)x1; and WHEREAS, on February 5, 1992, the Planning Commission approved 85(B), as described and conditioned in Planning Commission Resolution No. 3337. 0 * 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Ple Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the P1: Commission APPROVES Conditional Use Permit Extension CUP 85(B)x1 on the following findings and subject to the following conditions: Findinw: 1. All findings of Planning Commission Resolution No. 3337 apply to this condition permit extension and are incorporated herein by reference. Conditions: 1. This approval is subject to all conditions of Planning Commission Resolution except that Condition No. 2 of Resolution No. 3337 is superseded by Condition No this resolution. 2. This Conditional Use Permit is granted for a period of five years through Febru: 2002. This Conditional Use Permit shall be reviewed by the Planning Directol yearly basis to determine if all conditions of this permit have been met and that tk does not have a substantial negative effect on surrounding properties or the public 1 and welfare. If the Planning Director determines that the use has such subs1 negative effects, the Planning Director shall recommend that the Planning Commi after providing the permittee the opportunity to be heard, add additional conditic. reduce or eliminate the substantial negative effects. This permit may be revoked : time after a public hearing, if it is found that the use has a substantial detrimental on surrounding land uses and the public’s health and welfare, or the conditions im herein have not been met. This permit may be extended for a reasonable period 0: not to exceed five years upon written application of the permittee made no less th days prior to the expiration date. The Planning Commission may not grant extension, unless it finds that there are no substantial negative effects on surroundin: uses or the public’s health and welfare. If a substantial negative effect on surrou land uses or the public’s health and welfare is found, the extension shall be den- granted with conditions which will eliminate or substantially reduce such effects. ’ is no limit to the number of extensions the Planning Commission may grant. ... ... . .. ...
