A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
HILLSIDE DEVELOPMENT PERMIT AMENDMENT TO
ALLOW THE CONSTRUCTION OF 60 SINGLE FAMILY
UNITS ON PREVIOUSLY SUBDIVIDED LOTS ON
PROPERTY GENERALLY LOCATED EAST OF HIDDEN
VALLEY ROAD BETWEEN PALOMAR AIRPORT ROAD
PLAN AND LOCAL FACILITIES MANAGEMENT ZONE.

WHEREAS, Ladwig Design Group, Inc., has filed a verified application
the City of Carlsbad regarding property owned by Monarch Communities of Califo
“Owner”, described as

A portion of Lot “B” of Parcel Map No. 2993, in the City of Carlsbad,
County of San Diego, State of California, filed in the office of the
County Recorder of San Diego County August 23,1974 as File No. 74-
230326 of official records, and a portion of that certain parcel of land
delineated and designated as “Description No. 1,103.91 acres” on
record of survey Map No. 5715, filed in the office of the County
Recorder of San Diego County, December 19,1960, being a portion of
Lot “G” of Rancho Agua Hedionda, according to Map thereof No.
823, filed in the office of the County Recorder of San Diego County,
November 16, 1896, a portion of which lies within the City of
Carlsbad all being in the County of San Diego, State of California
excepting therefrom that portion, if any, lying within adjusted Parcel
1 (Kelly Property) described in Certificate of Compliance recorded
June 27,1996 as File No. 1996-0323495 of official records of San Diego
County.

WHEREAS, said verified application constitutes a request for a Hi
Development Permit Amendment as shown on Exhibits “A”-“W”, on file in the C~I
Planning Department, HDP 95-12(A), Emerald Ridge East, as provided by Chapter 21,
the Carlsbad Municipal Code; and

WHEREAS, the Planning Commission did on the 6th day of August 1
consider said request; and
WHEREAS, at said hearing, upon hearing and considering all testimony
arguments, if any, of all persons desiring to be heard, said Commission considered all fa
relating to the Hillside Development Permit Amendment; and
WHEREAS, on August 6, 1996, the City Council approved HDP 95-12 a
described and conditioned in Planning Commission Resolution No. 3938.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plar
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commi
APPROVES Hillside Development Permit Amendment, HDP 95-12(A), I
on the following findings and subject to the following conditions:
Findings:
1. All findings of HDP 95-12 as stated in Planning Commission Resolution No. :
shall apply as findings of HDP 95-12(A).
2. That the development proposal is consistent with the intent, purpose, and requiremen
the Hillside Ordinance, Chapter 21.95, in that the single family residential strucl

Airport Road and adjacent to Hidden Valley Road.
3. That the project design involving building placement and architecture substan
conforms to the intent of the concepts illustrated in the Hillside Development Guide
Manual, in that sufficient setbacks from adjoining downhill slopes will be provi
dominant roof and hillside slopes are parallel, exterior material and colors
consistent with the natural landscape, and walls/fences located at the top of sl
will follow the hillside contour, be consistent in color with the hillside landsc
and be in scale and proportion to the hillside landform.

Conditions:
1. The Planning Commission does hereby APPROVE the Hillside Development P
Amendment for the project entitled Emerald Ridge East (Exhibits “A7”“W97 1
August 6, 1997 which supersede Exhibits “A,” “J” and “K,” dated June 5, 199
file in the Planning Department and incorporated by this reference, subject tc
conditions herein set forth. Staff is authorized and directed to make, or require Deve
to make, all corrections and modifications to the Hillside Development PC
document(s), as necessary, to make them internally consistent and in conformity
final action on the project. Development shall occur substantially as shown ir
approved Exhibits. Any proposed development substantially different from this appr
shall require an amendment to this approval.
2. Approval of HDP 95-12(A) is granted subject to approval of SDP 95-ll(A) and
97-03. HDP 95-12(A) is subject to all conditions contained in Planning Commi;
Resolution for HDP 95-12 except as amended herein, and Planning Commi,
Resolutions No. 4150 and 4152, for SDP 95-11(A) and CDP 97-03.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Plar
Commission of the City of Carlsbad, California, held on the 6th day of August 1997, b
following vote, to wit:
