PLANNING COMMISSION RESOLUTION NO. 4152
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
ALLOW THE CONSTRUCTION OF 60 SINGLE FAMILY
HOMES ON PREVIOUSLY SUBDIVIDED LOTS WITHIN CT
PLANS, AND LOCATION OF NINE APPROVED SECOND
DWELLING UNITS ON PROPERTY GENERALLY LOCATED
EAST OF HIDDEN VALLEY ROAD BETWEEN PALOMAR
AIRPORT ROAD AND CAMINO DE LAS ONDAS IN THE
ZONE ’ 20 SPECIFIC PLAN AND LOCAL FACILITIES
MANAGEMENT ZONE.

WHEREAS, Ladwig Design Group, Inc., has filed a verified application with
the City of Carlsbad regarding property owned by Monarch Communities of California,
“Owner”, described as
COASTAL DEVELOPMENT PERMIT NO. CDP 97-03 TO
95-05, AND TO REVISE THE ARCHITECTURE, FLOOR
A portion of Lot “B” of Parcel Map No. 2993, in the City of Carlsbad,
County of San Diego, State of California, filed in the office of the
County Recorder of San Diego County August 23,1974 as File No. 74-
230326 of official records, and a portion of that certain parcel of land
delineated and designated as “Description No. 1,103.91 acres” on
record of survey Map No. 5715, filed in the office of the County
Recorder of San Diego County, December 19,1960, being a portion of
Lot “G” of Rancho Agua Hedionda, according to Map thereof No.
823, filed in the office of the County Recorder of San Diego County,
November 16, 1896, a portion of which lies within the City of
Carlsbad all being in the County of San Diego, State of California
excepting therefrom that portion, if any, lying within adjusted Parcel
1 (Kelly Property) described in Certificate of Compliance recorded
June 27,1996 as File No. 1996-0323495 of official records of San Diego
County.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Coastal
~ Development Permit as shown on Exhibits “A”-“W” dated August 6, 1997, on file .in the
’ Planning Department, CDP 97-03 as provided by Chapter 21.201.040 of the Carlsbad Municipal
Code; and

WHEREAS, the California Coastal Commission approved Coastal Develop
Permit 6-96-1 19 , dated October 9, 1996 and 6-96-1 19A dated February 20, 1997. All condi
of CDP 6-96-1 19 and 6-96-1 19A are applicable to this project; and
WHEREAS, the Planning Commission did, on the 6th day of August 1997,
a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testir
and arguments, if any, of all persons desiring to be heard, said Commission considered all fa
relating to CDP .
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plar
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commi:
APPROVES Coastal Development Permit, CDP 97-03, based on the follo.
findings and subject to the following conditions:
Findings:
1. That the proposed development is in conformance with the Certified Local Co
Program and all applicable policies in that the structural placement, second dwe:
units, and architecture of single family residential structures are consistent with
applicable R-1-7500-Q implementing zone standards.
2. The project is subject to and consistent with the Mello 11 LCP Segment Agricull
Overlay Zone in that it is required to offset the conversion of non-prime agricull
land to urban land uses through the payment of an agricultural mitigation fee
all sedimentation, erosion, and drainage measures were previously apprl
through the issuance of a Coastal Development Permit for CT 95-05 by
California Coastal Commission.
Conditions:
1. The Planning Commission does hereby APPROVE the Coastal Development Permj
the project entitled Emerald Ridge East (Exhibits “A”-“W” dated August 6, 199:
file in the Planning Department and incorporated by this reference, subject tc

document(s), as necessary, to make them internally consistent and in conformity
final action on the project. Development shall occur substantially as shown ir
approved Exhibits. Any proposed development substantially different from this appr
shall require an amendment to this approval.
2. Approval of CDP 97-03 is granted subject to approval of SDP 95-ll(A) and HDP
12(A). CDP 97-03 is subject to all conditions contained in Planning Commis
Resolutions No. 4150 and 4151, for SDP 95-ll(A) and HDP 95-12(A).
3. To offset the conversion of non-prime agricultural land to urban land uses pel
requirements of the Mello I1 Local Coastal Program, the applicant shall pro
payment of an agricultural mitigation fee, the amount of which shall not be less
$5,000 nor more than $10,000 for each net converted acre of non-prime agricull
land. The amount of the fee shall be determined by the City Council pria
approval of the final map or issuance of any building permit, whichever occurs
and shall be consistent with the provisions of Carlsbad's LCP.
PASSED, APPROVED AND ADOPTED at a regular meeting of the plan
Commission of the City of Carlsbad, California, held on the 6th day of August 1997, bJ
following vote, to wit:
