HomeMy WebLinkAbout1997-09-03; Planning Commission; Resolution 4166e 0 0 1 2 3 4 5 6 7 8 9 10 PLANNING COMMISSION RESOLUTION NO. 4166 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE LAND USE ELEMENT AND THE OPEN SPACE AND CONSERVATION ELEMENT OF THE GENERAL PLAN WHICH ADJUSTS THE BOUNDARIES OF THE OPEN SPACE, RESIDENTIAL LOW MEDIUM DENSITY, RESIDENTIAL MEDIUM DENSITY, RESIDENTIAL MEDIUM HIGH DENSITY, AND RESIDENTIAL HIGH DENSITY FOR PROPERTY GENERALLY LOCATED SOUTH OF PALOMAR AIRPORT ROAD, NORTH OF LOCAL FACILITIES MANAGEMENT ZONE 6, EAST OF BRESSI RANCH, AND WEST OF THE EASTERN CITY LIMITS. CASE NAME: RANCHO CARRILLO MASTER PLAN CASE NO: GPA 96-05 11 12 13 WHEREAS, Continental Ranch, Inc., “Developer”, has filed a vc application with the City of Carlsbad regarding property owned by Continental Ranch, 14 ll “Owner”,. described as 15 16 17 A portion of the southerly one half of Section 18 and a portion of Section 19, Township 12 South, Range 3 West, San Bernardino meridian and a portion of fractional Section 13 and a portion of fractional Section 24, Township 12 South, Range 4 West, San Bernardino Meridian, City of Carlsbad, County of San Diego, State of California. 18 19 20 (“the Property”); and WHEREAS, a verified application for an amendment to the General designation for certain property located, as shown on Exhibit “A”, dated September 3, attached and incorporated herein, has been filed with the Planning Commission; and 21 22 23 provided in Title 21 of the Carlsbad Municipal Code; and 24 WHEREAS, said verified application constitutes a request for amendme 26 25 WHEREAS, the Planning Commission did on the 3rd day of September hold a duly noticed public hearing as prescribed by law to consider said request; 27 28 ... 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 WHEREAS, at said public hearing, upon hearing and considering all testi: and arguments, if any, of all persons desiring to be heard, said Commission considered all fi relating to the General Plan Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla Commission of the City of Carlsbad, as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Pla~ Commission RECOMMENDS APPROVAL of General Plan Amendment 96-05, to revise the land use designations of the General Plan Map, a] accurately reflect these changes on the Official Open Space and Conserv Map of the Open Space and Conservation Element as shown on Exhibil dated September 3, 1997. Staff is authorized and directed to make, or re Developer to make, all necessary corrections and modifications to the Ge Plan Amendment document(s), as necessary, to make them internally cons and in conformity with final action on the project, based on the follc findings: Findings: 1. Goal "A" of the General Plan Land Use Element encourages the preservation enhancement of the environment, character, and image of the City as a desi residential, beach and open space oriented community. The project produi quality residential and open space orientation. 2. Goal "F" of the General Plan Land Use Element suggests protecting and conse: natural resources, fragile ecological areas, unique natural assets and histor significant features of the community. Within the 252 acres of Open Spac fragile, unique natural assets and historically significant features of the comm have been preserved. 3. Goal l.A.l of the Open Space Element delineates coordinating Open Space with other land uses for mutual enhancement and creation of a "human" u environment, which includes, but is not limited to, development and expansic recreational land, conservation of natural and manmade amenities, preservation of options with regard to agricultural land. The Master Amendment provides a synergistic experience between the passive open spacr community park site, the school site, and the day care and community recre area. 4. Open Space within the Master Plan has been reconfigured to address the received from the U. S. Fish and Wildlife Service, U. S. Army Corps of EngiI and the California Department of Fish and Game to improve the habitat value still providing a feeling of natural spaciousness and providing visual relief t residents of the Master Plan. 5. Goal 2.A.1 of the Open Space Element desires the exploration of all mea providing for Open Space needs. The Master Plan Amendment is increasin Open Space by approximately 2 acres. 6. Goal 2.A.2 of the Open Space Element is to assure that new development pro for the Open Space needs of its occupants. The Master Plan includes passivt active Open Space that exceeds the 15% standard required by the Local Fac Management Plan and the Planned Community Ordinance. Approximately 38 of the Master Plan is Open Space and that number will increase as discretic entitlements are issued. 7. Goal 3.A.2 of the Open Space Element is to protect and preserve visually attr; and/or significant natural areas. The Master Plan has been able to identifj preserve these areas in such a manner as to provide both private and p viewsheds and access. 8. Goal 3.A.3 of the Open Space Element suggests preserving Open Space areas natural a state as possible. A review of the Open Space plan indicates this i intent and conceptual goal of the document. 9. Goal 4.A.1 of the Open Space Element is to encourage larger and connected ( Space areas rather than numerous and disconnected areas. The Master Plal continually strived to meet this objective by constricting development to congl conjoined discrete areas to allow for larger connected Open Space areas. 10. Goal 4.A.2 requires the creation of natural and man-made links between ( Space areas. In general with this plan, such linkages are not required because t connectivity of the Open Space. However, where possible the linkages have provided. 11. The proposed Open Space area is equal to or greater than the area depicted o Open Space and Conservation Map since the Map since the General Amendment provides additional open space. 12. The proposed Open Space area is of environmental quality equal to or greater that depicted on the Open Space and Conservation Map as indicated by a revic the previously certified Environmental Impact Report for the Rancho Ca Master Plan, dated February 1993, and conformance of the Open Space wit proposed Habitat Management Plan and the U. The proposed adjustment to Open Space, as depicted on the Open Spacc Conservation Map , is contiguous or within close proximity to Open Space as s on the Open Space Map as confirmed by a review of the General Plan Amend Graphic. 14. Residential Guideline 1 of the Land Use Element is to retain the pl predominance of single family residences throughout the community. Of the 1 405 acres of residential land, 255.6 acres are proposed to be devoted to RLM medium density, 0-4 dwelling units per acre) single family development. 15. The Housing Element has a Goal 2 that new housing be developed with a divc of types, prices, tenures, densities and locations. This General Plan Amend increases the diversity of densities to meet that goal. 16. The Residential Guidelines of the Land Use Element limit multi-family develop to those areas where they are compatible with the adjacent land uses, and v adequate and convenient commercial services and public support systems su streets, parking, parks, schools, and utilities are adequate to serve them. Master Plan proposes a day care center, a community recreation center, the p park, and the public school to meet these needs. All multi-family sites Circulation Element Roadways. In the lone instance where a multi-family site : an existing multi-family site, the sites are separated by a significant landsc slope and the Master Plan conditions the future development to el compatibility through synonymous product type. 17. The Rancho Carrillo Master Plan provides for adequate facilities in conformar the development requirements established in the Zone 18 LFMP, as requirt Policy "A" of the General Plan Land Use Element which states that develop should only be permitted after adequate provisions for public facilities have provided.
