A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO THE RANCHO
CARFULLO MASTER PLAN ON PROPERTY GENERALLY
LOCATED SOUTH OF PALOMAR AIRPORT ROAD, NORTH
OF LOCAL FACILITIES MANAGEMENT ZONE 6, EAST OF
BRESSI RANCH.

WHEREAS, Continental Ranch, Inc., “Developer”, has filed a VE
application with the City of Carlsbad regarding property owned by Continental Ranch,
“Owner”, described as
A portion of the southerly one half of Section 18 and a portion of Section
19, Township 12 South, Range 3 West, San Bernardino meridian and a
portion of fractional Section 13 and a portion of fractional Section 24,
Township 12 South, Range 4 West, San Bernardino Meridian, City of
Carlsbad, County of San Diego, State of California.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Master
Amendment, on file in the Carlsbad Planning Department Master Plan Amendment 1:
dated September 3,1997, as provided by MP 139 and its amendments and Chapter 21.:
the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 3rd day of September 3
consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testir
and arguments, if any, of all persons desiring to be heard, said Commission considered all fa

WHEREAS, on July 20, 1993, the City Council approved, MP 139(1
described and conditioned in Planning Commission Resolution No. 3504.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Corn
RECOMMENDS APPROVAL of Master Plan Amendment MP 1390
adopted by Exhibit “X”, based on the following findings and subject I
following conditions:
Findines:
1. The proposed development as described by the Master Plan is consistent wit!
provisions of the General Plan as identified within the findings for GPA 9
Resolution No. 4166 and all findings of said resolution are incorporated here:
reference.
2. All necessary public facilities can be provided concurrent with need and adec,
provisions have been provided to implement those portions of the ca
improvement program applicable to the subject property. The Master Plan
language in the text stating that all future development shall comply with the p’
facility performance standards and phasing requirements of the Local Faci
Management Plan (LFMP) for Zone 18. Public facilities are required t
constructed as development in the Master Plan creates demand for addit
facilities. A financing plan approved by the City Council for the Zone 18 L:
will provide the mechanisms for the financing of the required public facilities.
3. The residential and open space portions of the community will constitutc
environment of sustained desirability and stability, and that it will be in harn
with or provide compatible variety to the character of the surrounding area,
that the sites proposed for public facilities, such as schools, playgrounds, and p;
are adequate to serve the anticipated population and appear acceptable to the pi
authorities having jurisdiction thereof.
The Open Space plan provides 252.2 acres of open space within the Master
which is to be used for the protection of biological habitat, the migration of wilc
trails for hikers and bicyclists, recreation, visual aesthetics, and buffers 1
developed areas.

Special Design Park District has been established which comers the
surrounding the Community Park site to ensure compatibility.
On April 15, 1997, the City Council approved the Reinstated Parks Agreeme]
the accepting of the park land dedication as offered by the property owner.
On February 23,1993 the San Marcos Unified School District Board directed
staff to pursue the dedication of the school site as so identified within the M
Plan.
4. In the case of institutional, recreational, and other similar nonresidential uses,
development will be proposed, and surrounding areas are protected from
adverse effects from such development. The Rancho Carrillo Community Par1
Public School Site, and the Day Care Site and Community Recreation Area a:
located adjacent to each other. They are bound to the north and east by Circul
Element roadways, on the west by Open Space, and to the south by collector si
and significant landscaped slopes and setbacks to ensure that surrounding area
protected from any adverse effects.
5. The streets and thoroughfares proposed are suitable and adequate to cary
anticipated traffic thereon. Traffic studies have been completed for the 1
Facilities Management Plan for Zone 18 and the previously certified EIR 4
Compliance with the mitigation conditions required by these studies and 1
would ensure that all circulation infrastructure is in place to serve the tl
demands generated by buildout of the Master Plan.
6. Appropriate measures are proposed to mitigate any adverse environmental in
as noted in the adopted environmental impact report for the project. All findin
EIR 91-04, certified by the City Council on July 27,1993 are incorporated here
reference.
7. The area surrounding the development is or can be planned and zone
coordination and substantial compatibility with the development. The projecl
extensive open space buffers on the east, west, and south. The proposed M
Plan Amendment will increase the size of these open space areas, especially a
the eastern boundary of the Master Plan. Where the project abuts existing s

Conditions:
1. The Planning Commission does hereby RECOMMEND APPROVAL of the h
Plan Amendment for the project entitled Rancho Carrillo Master Plan, MP 1
dated September 3, 1997, on file in the Planning Department and incorporated b,
reference, subject to the conditions herein set forth.) Staff is authorized and direci
make, or require Developer to make, all corrections and modifications to the Mastel
document(s) as necessary, to make them internally consistent and in conformity with
action on the project. Development shall occur substantially as shown in the app
Exhibits. Any proposed development substantially different from this approval,
require an amendment to this approval.
2. The developers shall comply with all applicable provisions of federal, state, and loca
ordinances in effect at the time of building permit issuance.
3. Approval of MP 139(F) is granted subject to approval of GPA 96-05.
4. If any of the foregoing conditions fail to occur; or if they are, by their terms,
implemented and maintained over time; if any such conditions fail to be so implem
and maintained according to their terms, the City shall have the right to revoke or m
all approvals herein granted; deny or further condition issuance of all future buj
permits; deny, revoke, or further condition all certificates of occupancy issued undc
authority of approvals herein granted; institute and prosecute litigation to compel
compliance with said conditions or seek damages for their violation. No vested righl

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ADOPTING THE RANCHO
CARRILLO MASTER PLAN AMENDMENT (MP 139(F)) ON
APPROXIMATELY 690 ACRES OF LAND LOCATED SOUTH
OF PALOMAR AIRPORT ROAD, NORTH OF LOCAL
FACILITIES MANAGEMENT ZONE 6, WEST OF THE
EASTERN CITY BOUNDARY, AND EAST OF THE BRESSI
RANCH PROPERTY (LOCAL FACILITIES MANAGEMENT
ZONE 17), IN LOCAL FACILITIES MANAGEMENT ZONE 18.
CASE NAME: RANCHO CARRILLO MASTER PLAN
CASE NO.: MP 139(F)
WHEREAS, the City Council of the City of Carlsbad has reviewed
considered a Master Plan for future development of the site; and
WHEREAS, after procedures in accordance with the requirements of the la\
City Council has determined that the public interest indicates that said plan be approved.
NOW, THEREFORE, the City Council of the City of Carlsbad does orda
follows:
SECTION I: That the Rancho Carrillo Master Plan, MP 139(F), I
September 3, 1997, on file in the Planning Department, and incorporated by reference here
approved. The Master Plan shall constitute the zoning for this property and all developme
the property shall conform to the plan.
SECTION 11: That the findings and conditions of the Planning Commissic
Planning Commission Resolution No. 4167 shall also constitute the findings and conditior

EFFECTIVE DATE: This ordinance shall be effective thirty days aft€
