HomeMy WebLinkAbout1997-09-03; Planning Commission; Resolution 4170r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e 0 PLANNING COMMISSION RESOLUTION NO. 4170 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A SPECIAL USE PERMIT TO ALLOW A 3- LOT INDUSTRIAL OFFICE DEVELOPMENT AND AN OPEN SPACE PARCEL ON PROPERTY GENERALLY LOCATED SOUTH OF COUGAR DRIVE ON THE EAST AND WEST SIDES OF PALMER WAY IN LOCAL FACILITIES MANAGEMENT ZONE 15 CASE NAME: PALMER WAY INDUSTRIAL PARK CASE NO: SUP 96-09 WHEREAS, Ron Lister, d.b.a. Lister Construction, “Developer”, has fil verified application with the City of Carlsbad regarding property owned by Ronald Craig L: and Colleen Marie Lister, Trustees, “Owner”, described as A portion of Parcel 1 of Parcel Map 10060, and a portion of Lot “B” of Rancho Agua Hedionda, all in the City of Carlsbad (‘the Property”); and WHEREAS, said verified application constitutes a request for a Special Permit as shown on Exhibit(s) “A” - “I” dated September 3, 1997, on file in the Plan Department (Palmer Way Industrial Park - SUP 96-09), as provided by the condition approval of SUP 96-09 and Chapter 21.40 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 3rd day of September 11 hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testim and arguments, if any, of all persons desiring to be heard, said Commission considered all fac relating to the Special Use Permit; NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plm Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. The project is consistent with the El Camino Real Corridor Development Stanc in that, although no development of Parcel 3 is proposed at this time, the gr; proposed to create the future building pad is consistent with the grading allowc the El Camino Real Corridor Development Standards, and the building pad I created can accommodate the required 30-foot building setback. 2. An amendment to this SDP will be required to approve any development of P 3, and that development will be required to comply with all applicable develop] standards contained in the El Camino Real Corridor Development Standards. Conditions: 1. The Planning Commission does hereby APPROVE the Special Use Permit fo project entitled Palmer Way Industrial Park (Exhibits “A” - “G” dated Septemk 1997 on file in the Planning Department and incorporated by this reference, subject 1 conditions herein set forth.) Staff is authorized and directed to make, or re Developer to make, all corrections and modifications to the Special Use P document(s), as necessary, to make them internally consistent and in conformity final action on the project. Development shall occur substantially as shown ir approved Exhibits. Any proposed development substantially different from this appr shall require an amendment to this approval. 2. Approval of SUP 96-09 is granted subject to the approval of SDP 96-13, and LFMI OS(D)/LFMP 15(A). SUP 96-09 is subject to all conditions contained in Plan Commission Resolutions No. 4169 and 4171 for SDP 96-13 and LFMP OS(D)/LFMP 15(A). ... ... ... ... ... I ...
