A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORVIA, RECOMMENDING
APPROVAL OF THE LOCAL FACILITIES MANAGEMENT
PLAN AMENDMENT FOR A ZONE BOUNDARY
ADJUSTMENT ON PROPERTY GENERALLY LOCATED
SOUTH OF COUGAR DRIVE ON THE EAST AND WEST
SIDES OF PALMER WAY
CASE NAME: PALMER WAY INDUSTFUAL PARK
CASE NO: LFMP 87-05(D)/LFMP 15(A)
WHEREAS, Ron Lister, d.b.a. Lister Construction, ”Developer”, has fil
verified application with the City of Carlsbad, regarding property owned by Ronald C
Lister and Colleen Marie Lister, Trustees, “Owner”, described as
A portion of Parcel 1 of Parcel Map 10060, and a portion of
Lot “B” of Rancho Agua Hedionda, all in the City of Carlsbad
(“the Property”); and
WHEREAS, the City Council passed Resolution No. 8797 adopting the 1
Citywide Facilities and Improvements Plan establishing facility zones and performance stand
for public facilities; and
WHEREAS, the City Council adopted Ordinance No. 81 10 and 9
implementing Proposition E approved on November 4, 1986 by the citizens of Carlsbad; and
WHEREAS, the Planning Commission did, on the 3rd day of September l!
hold duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testim
and arguments, if any, of all persons desiring to be heard, said Commission considered all fac
relating to the Local Facilities Management Plan Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plann
Commission as follows:

A) That the above recitations are true and correct
B) That based on the evidence presented at the public hearing, the Commi
RECOMMENDS APPROVAL of Local Facilities Management Plan ,
Amendment 87-05(D)lLFMP 15(A) based on the following findings and su
to the following conditions:
Findings:
1. That Local Facilities Management Plan amendments for Zones 15 and 5 are consi
with the Land Use Element and the other Elements contained in the General Plan, ir
adequate provision has been made for public facilities concurrent with need
public performance standards will be complied with, and funding for all neces
public facilities and services will be guaranteed prior to any development appro
grading or building permits in both zones.
2. That the Local Facilities Management Plan amendments for Zones 15 and 5
consistent with Chapter 21.90 of the Carlsbad Municipal Code (Growth Managem
and with the Citywide Facilities and Improvement Plan, in that the facility plans 1
been amended consistent with Section 21.90.110 and the proposed bounc
adjustment will not affect the implementation of either Zone 15 or Zone 5.
3. That Local Facilities Management Plan amendments for Zones 15 and 5 and
conditions contained therein will (continue to) promote the public safety and welfar
ensuring that public facilities will be provided in conformance with the ado
performance standards and will be available prior to development occurring, in tha
public facilities and services required for the development of the Palmer 7
Industrial Park (SDP 96-13iSUP 96-09), processed in association with this LF
Amendment, are either already in place or will be provided through condition
approval placed on the project approvals.
Conditions:
1. Approval is granted for Local Facilities ‘Management Plan Zone Amendment
05@)/LFMP 15(A) as shown on Exhibit “H” attached and incorporated herein
reference.
