A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
PROPERTY GENERALLY LOCATED ON FRANCISCAN
ROAD IN LOCAL FACILITIES MANAGEMENT ZONE 22.
CASE NAME: DONAHUE RESIDENCE
CASE NO.: CDP 97-27
WHEREAS, Richard Donahue , “Developer”, has filed a verified applic
with the City of Carlsbad regarding property owned by Richard and Marion Dona
“Owner”, described as
COASTAL DEVELOPMENT PERMIT NO. CDP 97-27 ON
La Costa Downs, Block 22, Lot 6
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Co
Development Permit as shown on Exhibit(s) “A” -“C” dated September 17, 1997, on file il
Planning Department, CDP 97-27, as provided by Chapter 21.201.040 of the Carlsbad Muni
Code; and
WHEREAS, the Planning Commission did, on the 17th day of September 1
hold a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testin
and arguments, if any, of all persons desiring to be heard, said Commission considered all fac
relating to CDP 97-27.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plan
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commis
APPROVES Coastal Development Permit CDP 97-27, based on the folio\
findings and subject to the following conditions:

Findings:
1. That the proposed development is in conformance with the Certified Local Cc
Program and all applicable policies in that the development is a single family hou;
a previously subdivided and graded lot without impact or potential to im
coastal resources including native vegetation, wetlands, slopes greater than 25‘
coastal views.
Conditions:
1. The Planning Commission does hereby APPROVE the Coastal Development Perm
the project entitled Donahue Residence (Exhibit(s) “A” - “C” dated Septembel
1997, on file in the Planning Department and incorporated by this reference, subje
the conditions herein set forth.) Staff is authorized and directed to make, or re(
Developer to make, all corrections and modifications to the Coastal Develop1
Permit document(s), as necessary, to make them internally consistent and in confor
with final action on the project. Development shall occur substantially as shown il
approved Exhibits. Any proposed development substantially different from this apprl
shall require an amendment to this approval.
2. Building permits shall be issued for this project within two (2) years of approva
or this Coastal Development Permit will expire unless extended per Sectior
21.201.210 of the Zoning Ordinance.
