A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
PROPERTY LOCATED AT 2499 JEFFERSON STREET IN
LOCAL FACILITIES MANAGEMENT ZONE 1.

WHEREAS, James Chin, “Developer”, has filed a verified application wit1

WHEREAS, at said public hearing, upon hearing and considering all testin 17

relating to CDP 97-30.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plan
Commission of the City of Carlsbad as follows:
23 11 A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Commis
APPROVES Coastal Development Permit CDP 97-30, based on the folloc
findings and subject to the following conditions:

Findings:
1. That the proposed development is in conformance with the Certified Local Coastal
Program, the Coastal Resource Protection Overlay Zone, the Coastal Shoreline
Development Overlay Zone and all applicable policies in that : 1) the proposed land
use of an additional single family dwelling is consistent with the land use and zoning
designations required by the LCP; 2) field visits indicate that there are no
proposed impacts to native vegetation or wetlands; and 3) there is no additional
grading proposed which would impact slopes of 25 percent or greater inclination.

The Planning Commission does hereby APPROVE the Coastal Development Permit for
the project entitled Heers Addition (Exhibit(s) “A” - “C”, dated September 17, 1997,
on tile in the Planning Department and incorporated by this reference, subject to the
conditions herein set forth.) Staff is authorized and directed to make, or require
Developer to make, all corrections and modifications to the Coastal Development
Permit document(s), as necessary, to make them internally consistent and in conformity
with final action on the project. Development shall occur substantially as shown in the
approved Exhibits. Any proposed development substantially different from this approval,
shall require an amendment to this approval.
Building permits shall be applied for and issued for this project within two (2) years
of approval or this coastal development permit will expire unless extended per
Section 21.201.210 of the Zoning Ordinance.
Prior to any future westerly expansion of the home at 2499 Jefferson Street, the
applicant shall comply with all provisions of Chapter 21.201 and 21.203.
Prior to a certificate of occupancy, the applicant shall install 20 feet of 4 inch asphalt
concrete behind the driveway apron on Jefferson Street.
Prior to the issuance of a building permit, the applicant shall record a deed
restriction, to the satisfaction of the Planning Director and City Attorney, over that
portion of the subject property located within 100 feet of the mean high tide line.
This area shall be reserved as a wetland buffer for habitat preservation.
Maintenance of this area shall be the responsibility of the property owner.
