A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
PLANNED UNIT DEVELOPMENT TO SUBDIVIDE 2.49
SAC DRIVEWAYS, AND ONE RECREATION FACILITY LOT,
FOR A TOTAL OF 22 LOTS, ON PROPERTY GENERALLY
LOCATED ON THE NORTH SIDE OF UNICORN10 STREET
WEST OF EL FUERTE STREET IN LOCAL FACILITIES
MANAGEMENT ZONE 6.
CASE NAME: MARVISTA AT LA COSTA
CASE NO.: PUD 97-05
WHEREAS, TRC Development Corp. (d.b.a.: “Avalon Homes”), “Develo
has filed a verified application with the City of Carlsbad regarding property owned by
Estate Collateral Management Company, “Owner”, described as
ACRES INTO 17 SINGLE-FAMILY LOTS, THREE CUL-DE-
Lots 518 through 521, inclusive, of La Costa Meadows Unit No.
3, Map 7076, in the City of Carlsbad, County of San Diego,
State of California.
(“the Property”); and
WHEREAS, said verified application constitutes a request for a Planned
Development as shown on Exhibit(s) “A” - “T” dated September 17, 1997, on file i~
Planning Department, Marvista at La Costa - PUD 97-05, as provided by Chapter 21.45 c
Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 17th day of September :
hold a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testir
and arguments, if any, of persons desiring to be heard, said Commission considered all fa
relating to the Planned Unit Development.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1a1
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commi
APPROVES Planned Unit Development PUD 97-05 , based on the follo
findings and subject to the following conditions:
Findings:
1. That the granting of this permit will not adversely affect and will be consistent
Chapter 21.45 of Title 21, the General Plan, applicable specific plans, master plans
all adopted plans of the City and other governmental agencies, in that the pr
complies with all City plans, policies, standards and guidelines and is simil:
surrounding existing development in the area.
2. That the proposed use at the particular location is necessary and desirable to prov
service or facility which will contribute to the long-term general well-being o
neighborhood and the community, in that the proposed project would implemen
Residential Medium High (RMH) density land use designated for the site b:
Carlsbad General Plan and such development is necessary both to continuc
balance of land uses established by said General Plan and to provide the fina
wherewithal to fund and construct planned and needed pubic facilities and ser
anticipated by the City’s Growth Management Plan.
3. That such use will not be detrimental to the health, safety, or general welfare of pe
residing or working in the vicinity, or injurious to property or improvements i:
vicinity, in that the project meets all applicable City standards and ordinances
has been found by the Planning Commission not to have any significant ad
environmental impacts.
4. That the proposed Planned Development meets all of the minimum develor
standards set forth in Chapter 21.45.090, the design criteria set forth in Section 21.45
and has been designed in accordance with the concepts contained in the D
Guidelines Manual, and the Guidelines for the Development of Small
established in Council Policy No. 44 in that lot sizes will exceed the 3,500 squarc
minimum size, building elevations will contain offsetting planes and articul
compatible with the small lot guidelines, the project provides adequate residen
guest parking, both active and passive recreation areas are provided in suffi
quantity, and standards are met for set-backs, storage, and building height.
5. That the proposed project is designed to be sensitive to and blend in with the n;
topography of the site, and maintains and enhances significant natural resources a
site, in that the minor finish grading associated with the proposal will not chang
basic contours of the fill pads created in rough grading approved in the 1

which grading created level pads in keeping with land contours of surroun
development; such finish grading will not significantly disturb mature native
non-native shrubs and grasses which have established on approximately 60
high manufactured fill slopes on the north side of the project site
6. That the proposed project’s design and density of the developed portion of the si
compatible with surrounding development and does not create a disharmoniot
disruptive element to the neighborhood, in that the two-story, small-lot, single-fa
design of the project will complement existing two-story single-family develop]
to the east as well as two-story condominiums and rental units immediately tc
west and south, across Unicornio Street; the courtyard driveway and unit clustt
configuration of the proposal is essentially similar to the courtyard driveway
cluster development of the project immediately to the west of the site, thus affor
a streetscape with a unified architectural theme.
7. That the project’s circulation system is designed to be efficient and well integrated
the project and does not dominate the project, in that the three courtyard drivel
provide immediate access to Unicornio Street for small numbers (six or fewel
single-family units, while preserving necessary lines of sight at corners and drivc
aprons and providing adequate capability for safe vehicle movement onsit
evidenced by use of full 32-foot wide improvements.
Conditions:
1. The Planning Commission does hereby APPROVE the Planned Unit Developn
for the project entitled Marvista at La Costa (Exhibit(s) “A” - “T” dated Septen
17, 1997, on file in the Planning Department and incorporated by this reference, sul
to the conditions herein set forth. Staff is authorized and directed to make, or rec
Developer to make, all corrections and modifications to the Planned Unit Developn
document(s), as necessary, to make them internally consistent and in conformity
final action on the project. Development shall occur substantially as shown in
approved Exhibits. Any proposed development substantially different from this apprc
shall require an amendment to this approval.
2. Approval of PUD 97-05 is granted subject to the approval of CT 97-08. PUD 97-C
subject to all conditions of approval for CT 97-05, Planning Commission Resolution
4175, incorporated herein by reference and on file in the Planning Department.
