A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVES COASTAL
GENERALLY LOCATED ON THE SOUTH SIDE OF
HUMMINGBIRD ROAD BETWEEN ROCK DOVE STREET
AND SANDERLING COURT IN LOCAL FACILITIES
MANAGEMENT ZONE 19.

CASE NO.: CDP 96-1 1
WHEREAS, Taylor-Woodrow Homes, “Developer”, has filed a VE
application with the City of Carlsbad regarding property owned by RDC Devco 11, “Oc
DEVELOPMENT PERMIT NO. CDP 96-11 ON PROPERTY
described as
Lots 101 through 114 inclusive and lots 117 through 122 inclusive of
CT 85-35 according to Map 12411 recorded June 29,1989
(“the Property”); and
WHEREAS, said verified application constitutes a request for a C
Development Permit as shown on Exhibits “A” - “N” dated October 15, 1997, on file
Planning Department, (Aviara Planning Area 3 - CDP 96-11) as provided by C1
2 1.20 1.040 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 15th day of October
hold a duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testj
and arguments, if any, of all persons desiring to be heard, said Commission considered all f
relating to CDP 96-11.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pk
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.

B) That based on the evidence presented at the public hearing, the Comm
APPROVES Coastal Development Permit CDP 96-11, based on the follc
findings and subject to the following conditions:
Findings:
1. That the proposed development is in conformance with the Certified Local C
Program and all applicable policies in that the project complies with all appli
development standards of the implementing zone (R-1) development standard!
the Aviara Master Plan, including required setbacks, building height limital
and requirements for open space.
2. The project is consistent with the Mello I Coastal Resource Overlay Zone in tha
project site contains no steep slopes or sensitive vegetation to be protected. Th
consists of pregraded building pads containing no vegetation communitic
wildlife habitat.
Conditions:
1. The Planning Commission does hereby APPROVE the Coastal Development Perm
the project entitled Aviara Planning Area 3 (Exhibits “A” - “N” dated Octobe
1997 on file in the Planning Department and incorporated by this reference, subject 1
conditions herein set forth.) Staff is authorized and directed to make, or re
Developer to make, all corrections and modifications to the Coastal Develop
Permit documents, as necessary, to make them internally consistent and in confo
with final action on the project. Development shall occur substantially as shown i
approved Exhibits. Any proposed development substantially different from this app~
shall require an amendment to this approval.
2. Approval of CDP 96-11 is granted subject to the approval of SDP 96-11. CDP 96-1
is subject to all conditions contained in Planning Commission Resolution No. 417
for SDP 96-11.
