CASE NAME: CARLSBAD CORPORATE PLAZA CASE NO.: CDP 97-10 WHEREAS, Carlsbad Corporate, LLC, “Developer”, has filed a ve: application with the City of Carlsbad regarding property owned by Carlsbad Corporate, 1 “Owner”, described as COASTAL DEVELOPMENT PERMIT NO. CDP 97-10 ON Parcel 3 of Parcel Map No. 3415, in the City of Carlsbad, County of San Diego, State of California, filed in the office of the County Recorder of San Diego County, January 21,1975 a file No. 75-014212 of official records. (“the Property”); and WHEREAS, said verified application constitutes a request for a Cc Development Permit as shown on Exhibit(s) “A” - “N” dated October 15, 1997, on file i Planning Department, Coastal Development Permit CDP 97-10 as provided by Ch, 2 1.201.040 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 15th day of October 1 hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon bearing and considering all testir and arguments, if any, of all persons desiring to be heard, said Commission considered all fi relating to CDP 97-10. B) That based on the evidence presented at the public hearing, the Comm APPROVES Coastal Development Permit CDP 97-10, based on the folk findings and subject to the following conditions: Findings: 1. That the proposed development is in conformance with the Certified Local Cc Program and all applicable policies in that the project will not affect agricul shoreline, coastal bluffs, or coastal access and is not within any of the coastal ov zones. Conditions: 1. The Planning Commission does hereby APPROVE the Coastal Development Perm the project entitled Carlsbad Corporate Plaza (Exhibit(s) “A-N” dated Octobel 1997, on file in the Planning Department and incorporated by this reference, subjc the conditions herein set forth.) Staff is authorized and directed to make, or re Developer to make, all corrections and modifications to the site plan and eleva document(s), as necessary, to make them internally consistent and in conformity final action on the project. Development shall occur substantially as shown il approved Exhibits. Any proposed development substantially different from this appr shall require an amendment to this approval. 2. Building permits shall be issued for this project within two (2) years of approvr this coastal development permit will expire unless extended per Section 21.201 of the Zoning Ordinance. 3. The approval of this proposal is not appealable to the California Co, Commission because the project is not located within the “appeal area”. 4. If a grading permit should be required for this project, grading activities sha limited to the months of April through September pursuant to Sec 21.030.040(B)(3) of the Carlsbad Municipal Code. 5.
