PLANNING COMMISSION RESOLUTION NO. 4191
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A ONE
YEAR EXTENSION OF TIME FOR A TENTATIVE MAP AND
RELATED PLANNING PERMITS.
CASE NAME: RANCHO REAL
CASE NO.: CT 90- 13x2
WHEREAS Charles J. McLaughlin, “Developer”, has filed a verified ap
with the City of Carlsbad regarding property owned by General Security Corporation, ‘i
described as
Being a portion of Lot “I” of the RANCHO AGUA
HEDIONDA, in the City of Carlsbad, County of San Diego,
State of California, according to Partition Map thereof No.
823, filed in the office of the County Recorder of said County,
November 16,1896
(“the Property”); and
WHEREAS, the Planning Commission did, on May 29, 1991, adopt Re
No. 3238, approving the tentative map for a 39 lot/35 unit subdivision, known as CT 9(
related planning permits PUD 90-16, HDP 90-19 and SUP 90-97; and
WHEREAS, if the Planning Commission approves extension of the 1
Map the related planning permits mentioned above will be automatically extended by c
of law pursuant to Carlsbad Municipal Code Section 21.58.020(b); and
WHEREAS, the Planning Commission did, on October 6, 1993, adopt Rc
No. 3544 approving a 1 year extension of the tentative map for CT 90-13 and related 1
permits; and

that extended all valid tentative maps; and

WHEREAS, the tentative map will expire on May 29, 1997, if not t
Consequently, the applicant for the tentative map, Athalon Property Services, has made
request for an extension of time to process toward a final map; and
WHEREAS, economic conditions and design issues with SDG & E haw
progress on the final map; and
WHEREAS, the project (tentative map and related planning perrr
reviewed for conformance with the current General Plan, Title 21, other City ordina
policies; and
WHEREAS, the Planning Commission did, on the 15'h day of October 1:
a duly noticed public hearing to consider all factors, testimony and arguments, if ar
persons desiring to be heard.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the !
Commission of the City of Carlsbad as follows:
. A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the I
Commission APPROVES the request for an extension of time for the I
tract map for Carlsbad Tract No. 90-13 and related planning permits (PUI
HDP 90-1 9 and SUP 90-07) for a period of one year from May 29, 1997
29, 1998, subject to all the original conditions of approval; based on the fc
findings and with the addition of a new condition:

1. That the design and improvements of the subdivision are consistent with the
Plan, Titles 20 and 21 (CMC), other City ordinances and policies as conditioned.

2. Prior to the issuance of Grading Permits or Building Permits, whichever cor
this project must comply with any applicable requirements contained
Carlsbad Habitat Management Plan
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Commission of the City of Carlsbad, California, held on the 5th of November 199’
following vote, to wit:
