A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
82,000 SQUARE FOOT BUILDING CONTAINING SPACE
FOR OFFICE, RESEARCH AND DEVELOPMENT,
MANUFACTURING AND WAREHOUSE USES ON 5.09
ACRES OF PROPERTY GENERALLY LOCATED ON THE
EAST SIDE OF ARMADA DRIVE NORTH OF PALOMAR
AIRPORT ROAD WITHIN PLANNING AREA 2 OF THE

11,1996, in the Office of the County Recorder as file No. 1996-
0463214 in the City of Carlsbad, County of San Diego, State of

WHEREAS, said verified application constitutes a request for a
Planning Department, CDP 97-28 as provided by Chapter 21.201.040 of the Carlsbad M 21

WHEREAS, the Planning Commission did, on the 19th day of Novemb
25 ll hold a duly noticed public hearing as prescribed by law to consider said request; and

NOW, THEREFORE, BE IT HEREBY RESOLVED by the
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Cor
APPROVES Coastal Development Permit CDP 97-28, based on the f
findings and subject to the following conditions:
Bindings:
1. That the proposed development is in conformance with the Certified Local
Program and all applicable policies in that the project is in compliance .
relevant policies of the Mello 11 Segment of the Local Coastal Progr:
Carlsbad Ranch Specific Plan which serves as partial implementation for tl
11 Segment for the project site, and the Coastal Resource Protection Overlay
2. The project complies with the requirements of the Coastal Resource PI
Overlay Zone as the project site has been previously graded pursuant to tht
Tentative Map (CT 94-09) for the Carlsbad Ranch. No sensitive vegetation (
the project site. Drainage facilities to remove pollutants from site runoff
provided. The time limitations on grading in the Coastal Zone have been a]
a condition of this permit.
Conditions:
1. The Planning Commission does hereby APPROVE the Coastal Development PC
the project entitled CDP 97-28 (Exhibit(s) “A” - “F” dated November 19, 199
in the Planning Department and incorporated by this reference, subject to the cc
herein set forth.) Staff is authorized and directed to make, or require Developer
all corrections and modifications to the Coastal Development Permit docume

is granted subject to all conditions contained in the Planning Commission Resoh
for SDP 97-13.
4. All grading activity shall be prohibited between October 1st and April 1st of any 1
or as otherwise allowed by the Mello I1 Local Coastal Program.

5. Prior to the issuance of building permits, the Agricultural Conversion Mitig
Fee shall be paid by the developer for approximately 0.45 acres as requirc
the Mello I1 Segment of the Local Coastal Program and California Ca
Commission Permit Number 6-96-9.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Commission of the City of Carlsbad, California, held on the 19th day of November 199
following vote, to wit:

Monroy, Noble, Savary, and Welshons
