COASTAL DEVELOPMENT PERMIT NO. CDP 97-28 FOR AN CASE NAME: NATURAL ALTERNATIVES INTERNA- TIONAL HEADQUARTERS CASE NO.: CDP 97-28 11 WHEREAS, Koll Real Estate Group, a Delaware corporation, “De- 12 Carltas Company, a California corporation, “Owner”, described as 13 has filed a verified application with the City of Carlsbad regarding property ownec 14 15 16 17 18 I Lot 6 and a portion of Lot 7 of Carlsbad Tract No. 94-09, Carlsbad Ranch Unit 1 as per Map No. 13357 filed September 11,1996, in the Office of the County Recorder as file No. 1996- 0463214 in the City of Carlsbad, County of San Diego, State of California. ~ (“the Property”); and 19 Development Permit as shown on Exhibit(s) “A” - “F” dated November 19,1997, on fi 20 WHEREAS, said verified application constitutes a request for a Planning Department, CDP 97-28 as provided by Chapter 21.201.040 of the Carlsbad M 21 22 11 Code; and 23 24 WHEREAS, the Planning Commission did, on the 19th day of Novemb 25 ll hold a duly noticed public hearing as prescribed by law to consider said request; and 26 WHEREAS, at said public hearing, upon hearing and considering all te 27 relating to CDP 97-28. 28 and arguments, if any, of all persons desiring to be heard, said Commission considered a1 F r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 a NOW, THEREFORE, BE IT HEREBY RESOLVED by the Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Cor APPROVES Coastal Development Permit CDP 97-28, based on the f findings and subject to the following conditions: Bindings: 1. That the proposed development is in conformance with the Certified Local Program and all applicable policies in that the project is in compliance . relevant policies of the Mello 11 Segment of the Local Coastal Progr: Carlsbad Ranch Specific Plan which serves as partial implementation for tl 11 Segment for the project site, and the Coastal Resource Protection Overlay 2. The project complies with the requirements of the Coastal Resource PI Overlay Zone as the project site has been previously graded pursuant to tht Tentative Map (CT 94-09) for the Carlsbad Ranch. No sensitive vegetation ( the project site. Drainage facilities to remove pollutants from site runoff provided. The time limitations on grading in the Coastal Zone have been a] a condition of this permit. Conditions: 1. The Planning Commission does hereby APPROVE the Coastal Development PC the project entitled CDP 97-28 (Exhibit(s) “A” - “F” dated November 19, 199 in the Planning Department and incorporated by this reference, subject to the cc herein set forth.) Staff is authorized and directed to make, or require Developer all corrections and modifications to the Coastal Development Permit docume necessary, to make them internally consistent and in conformity with final actio project. Development shall occur substantially as shown in the approved Exhibi proposed development substantially different from this approval, shall rec amendment to this approval. 2. Building permits shall be issued for this project within two (2) years of appr or this coastal development permit will expire unless extended per Set 21.201.210 of the Zoning Ordinance. 3. Approval of CDP 97-28 is granted subject to the approval of SDP 97-13. CDP 9 is granted subject to all conditions contained in the Planning Commission Resoh for SDP 97-13. 4. All grading activity shall be prohibited between October 1st and April 1st of any 1 or as otherwise allowed by the Mello I1 Local Coastal Program. Prior to the issuance of building permits, the Agricultural Conversion Mitig Fee shall be paid by the developer for approximately 0.45 acres as requirc the Mello I1 Segment of the Local Coastal Program and California Ca Commission Permit Number 6-96-9.
