A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO THE LAND USE
ELEMENT OF THE GENERAL PLAN FROM RESIDENTIAL
MEDIUM DENSITY/OFFICE (MO), RESIDENTIAL
MEDIUM HIGH DENSITY (RMH) AND RESIDENTIAL/
MEDIUM HIGH DENSITY/TRAVEL RECREATION
COMMERCIAL (RMWTR) TO RESIDENTIAL MEDIUM
(RMH), RESIDENTIAL HIGH DENSITY (RH), TRAVEL
RECREATION COMMERCIALRESIDENTIAL HIGH
DENSITY (TR/RH), TRAVEL RECREATION COMMERCIAL

WHEREAS, HSL/BP/Michan L.P., “Developer”, has filed a verified applic;
with the City of Carlsbad regarding property owned by HSL/BP/Michan, L.P., “OW
described as shown on Exhibit “A”, as attached to Planning Commission Resolution No. 4
hereby incorporated by reference; and
DENSITY (RM), RESIDENTIAL MEDIUM-HIGH DENSITY
LOCATED NORTH OF LAKE SHORE GARDENS MOBILE-
WHEREAS, said verified application constitutes a request for a General
Amendment, attached hereto marked Exhibit “D”, and incorporated by this reference
provided in Government Code Sections 65350 et. Seq. and Section 21 S2.160 of the Carl:
Municipal Code, respectively; and
WHEREAS, the Planning Commission did, on the 5th day of November I!
the 19th day of November 1997, and on the 3rd day of December 1997 hold duly not]
public hearings as prescribed by law to consider said request;

WHEREAS, at said public hearing, upon hearing and considering all testi~
and arguments, if any, of all persons desiring to be heard, said Commission considered all fs
relating to the General Plan Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plar
Commission of the City of Carlsbad, as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Plan
Commission RECOMMENDS APPROVAL of General Plan Amendment (
95-06, to amend the Land Use Element of the General Plan from Reside
Medium Density/Office (RM/O), Residential Medium High Density (R!
and Residentiamedium High Density/Travel Recreation Comme
(RMH/TR) to Residential Medium Density (RM), Residential Medium-]
Density (RMH), Residential High Density (RH), Travel Recres
CommerciaUResidential High Density (TR/RH), Travel Recrea
Commercial (TR) and Open Space (OS), as shown on Exhibit “D”. Sta
authorized and directed to make, or require Developer to make, all neces
corrections and modifications to the General Plan Amendment documenl
necessary, to make them internally consistent and in conformity with final a(
on the project, based on the following findings:
Findincs:
1. The Planning Commission finds that the project, as conditioned herein for
amendment to the General Plan Land Use Designations as shown on Exhibit “D” i
conformance with the Elements of the City’s General Plan, based on the following:
a) Land Use Element
i) Goal A.l (Land Use Goals) “A City which preserves and enhances
environment, character and image of itself as a desirable residen,
beach and open space oriented community.” The project propc

ii) Goal A.3 A (Land Use Goals) “A City which provides for land L

iii) Goal A.l (Growth Management and Public Facilities Goals) “A
which ensures the timely provision of adequate public facilitie!
service to preserve the quality of life of residents.” The specific

developed to be consistent with, and implement the Zone 22 1
Facilities Management Plan, as amended.
iv) Goal A.4 (Commercial Goals) “A City which promotes recreat
and tourist-oriented land uses which serve visitors, employees a
industrial and business centers, as well as residents of the City.”

site to urban uses. The project will not however, result in
conversion of prime agricultural land to urban uses and no signif
impact to prime agricultural farmland is anticipated.
b) Housing Element
i) Goal 2 (Quantity and Diversity of Housing Stock) “New hol
development with a diversity of types, prices, tenures, densities
locations.. .” The Specific Plan includes both multiple family atta
and single family detached housing types at densities ranging frc
ddac to 19 du/ac. One planning area (PA 5) has been designate1
affordable housing. In addition, some rental units of PA 6 and 1
59 second dwelling units of Planning Areas 2, 4, 7 and 8 have
designated affordable. The remainder of the project will COI
market rate rental and for-sale units.
ii) Policy 3.6.a (Inclusionary) “A minimum of fifteen percent of all 1

spaces as space for possible livejwork situations.
c) Circulation Element
i) Objective B.1 (Streets and Traffic Controls) “To provide an adeq
circulation infrastructure concurrent with or prior to the ac
demand for such facilities.” A phasing plan has been prepared fo
project which identifies necessary improvements prior to each le\
development.
ii) Policy C.l (Streets and Traffic Controls) “To require
development to comply with the adopted Growth Manager
performance standards for circulation facilities.” A transporta
analysis has been prepared for the project which shows the proj
compliance with Growth Management performance standards.
iii) Objective B.l (Alternative Modes of Transportation) “To pro
infrastructure and facilities necessary to accommodate pedestri
bicycles, and other non-automobile modes of transportation.”

3. That there have been sufficient developments approved in the quadrant at densities 1

Conditions:
1. Approval of GPA 95-06 is granted subject to the approval of EIR 96-01, LCPA 9
ZC 95-06, SP 210, and LFMP 87-22(A) and approval of LCPA 96-03 by the Cc
Commission. GPA 95-06 is subject to all conditions contained in Plal
Commission Resolution No. 4157 for the Program EIR.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Pla
Commission of the City of Carlsbad, California, held on the 3rd day of December 1997,l
following vote, to wit:
