HomeMy WebLinkAbout1997-12-03; Planning Commission; Resolution 4159- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 PLANNING COMMISSION RESOLUTION NO. 4159 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE CARLSBAD LOCAL COASTAL PROGRAM TO BRING THE LOCAL COASTAL PROGRAM INTO CONFORMANCE WITH THE GENERAL PLAN, THE NEW SPECIFIC PLAN AND THE NEW ZONING MAP REGARDING PROPERTY GENERALLY LOCATED ON THE NORTH OF LAKE SHORE GARDENS MOBILEHOME PARK SOUTH OF THE POINSETTIA TRANSIT STATION AND LANIKAI LANE MOBILEHOME PARK, WEST OF AVENIDA ENCINAS, AND EAST OF CARLSBAD BOULEVARD IN LOCAL FACILITIES MANAGEMENT ZONE 22. CASE NAME: POINSETTIA PROPERTIES SPECIFIC PLAN CASE NO: LCPA 96-03 WHEREAS, California State law requires that the Local Coastal Proi General Plan, and Zoning designations for properties in the Coastal Zone be in conformance WHEREAS, HSLBPMichan L.P., “Developer”, has filed a verified applic for an amendment to the Local Coastal Program designations regarding property ownel HSLBPMichan L.P., “Owner”, and described in Exhibit “A’ attached to Plan Commission Resolution No. 4157, hereby incorporated by reference. WHEREAS, said verified application constitutes a request for a Local Co Program Amendment; to the Land Use Plan map designations for the Mello I1 Segmel shown on Exhibit “E’? and a change to Land Use Policy 6-9 as shown on Exhibit “F”, atta hereto and incorporated by this reference; and the implementation document, Poinsl Properties Specific Plan, dated November 19, 1997, (Exhibit “G” to Planning Commis Resolution No. 4161), including the zone change therein and, incorporated by this refer (LCPA 96-03), as provided in Public Resources Code Section 30574 and Artkle 1 Subchapter 8, Chapter 2, Division 5.5 of Title 14 of the California Code of Regulations 1 California Coastal Commission Administrative Regulations); and I 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ' 27 28 WHEREAS, the Planning Cornmission did on the 5th day of November 199' 19th day of November 1997, and on the 3rd day of December 1997 hold duly noticed p hearings as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testil and arguments, if any, of all persons desiring to be heard, said Commission considered all fa relating to the Local Coastal Program Amendment. WHEREAS, State Coastal Guidelines requires a six week public review peric any amendment to the Local Coastal Program. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Pla Commission of the City of Carlsbad, as follows: A) That the foregoing recitations are true and correct. B) At the end of the State mandated six week review period, starting on Jul! 1997, and ending on September 4, 1997, staff shall present to the City Cow summary of the comments received. C) That based on the evidence presented at the public hearing, the Commi; RECOMMENDS APPROVAL of LCPA 96-03, based on the follo findings, and subject to the following conditions: Findings: 1. That the proposed Local Coastal Program Amendment is consistent with all applic policies of the Mello I1 segment of the Carlsbad Local Coastal Program, in that: a. Consistent with Policy 6-5 of the Mello I1 Segment, restaurants and o visitor-serving facilities will be provided within the Coastal Zone Specific Plan area at the intersection of Carlsbad Boulevard and Ponto I. (Planning Area 1) and on Avenida Encinas at the Poinsettia Rail Sts (Planning Area 6). b. As provided for in Policy 8-1 of the Mello I1 Segment, each planning are this specific plan is subject to discretionary review in the form of a Development Plan or Planned Development Permit. Policy 5-5 of the Mello I1 Segment requires that Poinsettia j improvements be completed to Carlsbad Boulevard. This project has designed with all required frontage improvements and the Poinsettia BI will be constructed as a Capital Improvement project by the City, 1 warranted. d. As provided in Policy 4-7 all necessary drainage facilities and runoff co measures will be complied with as evidenced by the drainage improven: identified in the specific plan. e. The Poinsettia Properties Specific Plan, which is the implementation pla~ this area, complies with all policies of the Mello I1 Segment and will prc for consistency between the implementation plan and the land use plan; 2. That the proposed amendment to the "ello I1 segment of the Carlsbad Local Cc Program is required to bring the designations of the City's General Plan Land Map (as amended), Zoning Map (as amended), and Mello I1 Segment Land Use 1 into conformance. Conditions: 1. Approval of LCPA 96-03 is granted subject to the approval of EIR 96-01, GPA 95 ZC 95-06, and LFMP 87-22(A) and is subject to all conditions in Plan; Commission Resolution No. 4157 for the Program EIR. ... ... ... ... ... ... ~ ... 1 ... Mello I1 Segment The Mello I1 Segment of the Carlsbad Local Coastal Program Land Use Plan is amended to read as follows: “The South Carlsbad State Beach campground should be considered for conversion to a day use beach and upland park if other adequate campground facilities can be develop nearby. Mixed use development (i.e., residential and recreational-commercial) shall be permitted by right except as provided by a Specific Plan or Muster Plan adopted to implement LCPpolicies on properties fronting Carlsbad Boulevard across from South Carlsbad State Beach (See Exhibit 4.9, Page 62). This policy applies only where not in conflict with the agricultural policies of the LCP.”
