PLANNING COMMISSION RESOLUTION NO. 4162
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF AN AMENDMENT TO THE LOCAL
FACILITIES MANAGEMENT PLAN FOR ZONE 22 ON
PROPERTY GENERALLY LOCATED NORTH OF LAKE
SHORE GARDENS MOBILEHOME PARK, SOUTH OF THE
POINSETTIA TRANSIT STATION AND LANIKAI LANE
MOBILEHOME PARK, WEST OF AVENIDA ENCINAS, AND
EAST OF CAFUSBAD BOULEVARD.

CASE NO: LFMP 87-22(A)
WHEREAS, HSLBPNichan L.P., ”Developer”, has filed a verified applic
with the City of Carlsbad, regarding property owned by HSLBPNichan L.P., “Ow
described as shown on Exhibit “A’, as attached to Planning Commission Resolution No. L
hereby incorporated by reference.
WHEREAS, said application constitutes a request for a Local Faci
Management Plan Amendment for Zone 22 (a notebook consisting of 36 pages, dated At
1,1997, on file in the Planning Department, and incorporated by this reference) (LFMP ZOI
Amendment), as provided for in Section 21.90.125 of the Carlsbad Municipal Code; and
WHEREAS, the City Council passed Resolution No. 8797 adopting the
Citywide Facilities and Improvements Plan establishing facility zones and performance stan
for public facilities; and
WHEREAS, the City Council adopted Ordinance No. 81 10 and
implementing Proposition E approved on November 4, 1986 by the citizens of Carlsbad; anc
WHEREAS, the Planning Commission did, on the 5th day of November
the 19th day of November 1997, and on the 3rd day of December 1997 hold duly nc
public hearings as prescribed by law to consider said request; and

WHEREAS, at said public hearing, upon hearing and considering all testir
and arguments, if any, of all persons desiring to be heard, said Commission considered all fa
relating to the Local Facilities Management Plan Amendment for Zone 22.
WHEREAS, on December 13, 1988, the City Council approved, the LFM
Zone 22, by City Council Resolution No. 88-428.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the P1a1
Commission as follows:
A) That the above recitations are true and correct
B) That based on the evidence presented at the public hearing, the Commi
RECOMMENDS APPROVAL of LFMP Zone 22 Amendment based o
following findings and subject to the following conditions:
Findings:
1. That Local Facilities Management Plan amendment for Zone 22 is consistent wit
Land Use Element, and the other Elements contained in the General Plan, in ths
project is consistent with Growth Management Policies C-1, C-2, and C-3 a
Land Use Element of the General Plan, in that:
a. Adequate provision has been made for the provision of public fac
concurrent with need;
b. All public facilities performance standards will be complied with; and
c. Funding for all necessary public facilities and services will be guaral
prior to any development approvals, grading or building permits.
2. That the Local Facilities Management Plan amendment for Zone 22 is consistent
Chapter 21.90 of the Carlsbad Municipal Code (Growth Management), and wit
Citywide Facilities and Improvement Plan, in that this facility plan has been amc
consistent with Section 21.90.110, and all facility and service impacts (dem;
associated with the proposed land use changes effected by the companion app
of SP 210 have been analyzed and adequate development requirements respa
to those changes have been incorporated.
3. That the Local Facilities Management Plan for Zone 22 and the conditions coni
therein will promote the public safety and welfare by ensuring that public facilitie
be provided in conformance with the adopted performance standards and will be ava

prior to development occurring, in that all public facilities and services require(
the development of the Poinsettia Properties Specific Plan (SP 210), processc
association with this LFMP amendment, are either already in place or wi
provided through conditions of approval placed on the future tentative maps 01
development plans for the specific plan area.
4. The Local Facilities Management Plan for Zone 22 will control the timing and loca
of growth by tying the pace of development to the provision of public facilitie:
improvements, in that the Zone 22 LFMP contains a phasing plan as well as a fa'
financing plan to ensure the coordination of development with the provisicl
necessary public facilities and services.
5. The Local Facilities Management Plan for Zone 22 will ensure public facilities
services are available in conformance with the adopted performance stand
prior to development occurring as it links the rate of development to the prov
of necessary public facilities and services.
Conditions:
1. Approval is granted for an amendment to Local Facilities Management Plan - Zone 1
contained in the plan titled Local Facilities Management Plan Zone 22, dated Augt
1997, incorporated herein by reference. The amended Zone 22 Local Faci
Management Plan, dated August 1, 1997, LFMP Zone 22 Amendment as hc
approved supplements the Zone 22 LFMP, dated August 1,1997.
2. Approval of LFMP 87-22(A) is granted subject to the approval of EIR 96-01, GPA
06, LCPA 96-03, ZC 95-06 and SP 210. LFMP 87-22(A) is subject to all condi
contained in Planning Commission Resolution No. 4157 for the Program EIR.
