CASE NAME: SUNRISE LA COSTA CASE NO: SI” 97-01 WHEREAS, Sunrise Development, Inc., “Developer”, has filed a application with the City of Carlsbad regarding property owned by Don Ayres, “ described as Lot 1 of Carlsbad Tract 72-34 (Rancho La Cuesta) Unit No. 1 in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 8350, as recorded in the Office of the County Recorder of San Diego County dated July 28,1976. (“the Property”); and WHEREAS, said verified application constitutes a request for a Spe Permit as shown on Exhibit(s) “A” - “Y” dated December 17, 1997, on file in the Planning Department, SUP 97-01 - Sunrise La Costa, as provided by Chapter 21.4 Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 17th day of Decemb hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all ti and arguments, if any, of all persons desiring to be heard, said Commission considered a relating to SUP 97-01. B) That based on the evidence presented at the public hearing, the Cor APPROVES Special Use Permit, SUP 97-01, based on the following and subject to the following conditions: Findings: 1. The project design is consistent with the El Camino Real Corridor Dew Standards for Area 5 adopted to regulate public improvements, arcb building height, signage, grading, and structural setbacks within the El Real Scenic Corridor Overlay Zone as required by Section 21.40.110 Preservation Overlay Zone) of the Zoning Ordinance in that the Spanish architecture is consistent with the required “Old California” architecturr and roof equipment will be concealed by roof parapets, public impro include the construction of a landscaped median on El Camino Real from Parkway to the southern project boundary with dual left turn lanes and a ri lane on Aviara Parkway, building height does not exceed 35 feet, grading I to accommodate the structure is minimal and less than the 10 foot maximu] fill permitted, the stucco and wood monument signage is within the m height and width permitted for Area 5, and the 80 to 90 foot structural setba El Camino Real exceeds the 45 feet minimum required. 2. The project is consistent with the “Scenic Corridor Guidelines” in that the - way landscape design consists of an informal design and includes the theme, and median trees recommended for the El Camino Real and Aviara IF corridors and no walls with the potential to obstruct views through the required for this project. Conditions: 1. The Planning Commission does hereby APPROVE the Special Use Permit project entitled Sunrise La Costa (Exhibit(s) “A” - “Y” dated December 17, file in the Planning Department and incorporated by this reference, subjec conditions herein set forth.) Staff is authorized and directed to make, 01 Developer to make, all corrections and modifications to the Special Us€ document(s), as necessary, to make them internally consistent and in conforn final action on the project. Development shall occw substantially as show approved Exhibits. Any proposed development substantially different from this a shall require an amendment to this approval. 2. Approval of SUP 97-01 is granted subject to the approval of CUP 97-04, HDI and CDP 97-08. SUP 97-01 is subject to all conditions contained in the : Commission Resolution for CUP 97-04 (4212), HDP 97-06 (4214), and CD (4215).
