CASE NAME: SUNRISE LA COSTA CASE NO: CDP 97-08 WHEREAS, Sunrise Development, Inc., “Developer”, has filed a application with the City of Carlsbad regarding property owned by Don Ayres, ‘ described as Lot 1 of Carlsbad Tract 72-34 (Rancho La Cuesta) Unit No. 1 in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 8350, as recorded in the Office of the County Recorder of San Diego County dated July 28,1976. (“the Property’’); and WHEREAS, said verified application constitutes a request for a Development Permit as shown on Exhibit(s) “A” - “Y” dated December 17,1997, on f, Carlsbad Planning Department, CDP 97-08 - Sunrise La Costa, as provided by Chapte of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did;on the 17th day of Decembl hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all tt and arguments, if any, of all persons desiring to be heard, said Commission considered a1 relating to CDP 97-08. B) That based on the evidence presented at the public hearing, the Cor APPROVES Coastal Development Permit CDP 97-08, based on the f findings and subject to the following conditions: Findings: 1. That the proposed development is in conformance with the Certified Loca: Program (Mello I1 segment) and all applicable policies and the applicable dew standards of Chapter 21.201 and Coastal Resource Protection requirements of 21.203, in that the project is required to obtain a grading permit rl compliance with the City’s standards to ensure erosion control, sediment and adequate drainage facilities in developed areas in accordance wi Standards and grading is limited to the summer season between Apri October 1 of each year. The project is located outside the coastal s development overlay zone; therefore, compliance with the public acc recreation policies of Chapter 3 of the Coastal Act is not required. No coastal resources will be impacted in that the site has been previously distu authorized grading. Conditions: 1. The Planning Commission does hereby APPROVE the Coastal Development Pt the project entitled CDP 97-08 - Sunrise La Costa, (Exhibit(s) “A” - “I December 17, 1997, on file in the Planning Department and incorporated reference, subject to the conditions herein set forth.) Staff is authorized and dil make, or require Developer to make, all corrections and modifications to the COI Use Permit document(s), as necessary, to make them internally consistent conformity with final action on the project. Development shall occur substar shown in the approved Exhibits. Any proposed development substantially differ this approval, shall require an amendment to this approval. 2. Approval of CDP 97-08 is granted subject to the approval of CUP 97-04, SU: and HDP 97-06. CDP 97-08 is subject to all conditions contained in the : Commission Resolution for CUP 97-04 (4212), SUP 97-01 (4213), and HD (4214). 3. Building permits shall be issued for this project within two (2) years of appr or this coastal development permit will expire unless extended per Sec 21.201.210 of the Zoning Ordinance. 4. All grading operations shall be limited to the period from April 1 to October each year. All areas disturbed by grading shall be planted within 60 days 0: initial disturbance and prior to October 1 with temporary or permanent (in case of finished slopes) erosion control methods.
