PLANNING COMMISSION RESOLUTION NO. 3940
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A ZONE CODE AMENDMENT, AMENDING
TITLE 21, CHAPTERS 21.95 AND 21.53, OF THE CARLSBAD
MUNICIPAL CODE TO STREAMLINE THE HILLSIDE
DEVELOPMENT PERMIT PROCESS, CLARIFY AND
SIMPLIFY THE ORDINANCE TO MAKE IT MORE USER
FNENDLY AND ADD NEW DEVELOPMENT STANDARDS
TO ADDRESS ORDINANCE ISSUE AREAS.

WHEREAS, the City Council has approved a Community Developn:
Workplan for Streamlining the Development Review and Permitting Processes;
WHEREAS, this Workplan recommended revisions to the City’s Hill
Ordinance as a high priority streamlining worktask;
WHEREAS, staff has prepared revisions to Chapter 21.95 and 21.53 of
Carlsbad Municipal Code to accomplish this streamlining objective;
WHEREAS, the revisions take the form of a zone code amendment;
WHEREAS, the Planning Commission did on the 4th day of December l!
the 15th day of January 1997, the 19th day of February 1997, the 4th day of June 1997,
18th day of June 1997, the 16th day of July 1997, the 20th day of August 1997, the 1st
of October 1997, the 15th day of October 1997, and on the 7th day of January 1998, ho
duly noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testim
and arguments, if any, of all persons desiring to be heard, said Commission considered
factors relating to the Zone Code Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plant
Commission as follows:

A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commis,
RECOMMENDS APPROVAL of Zone Code Amendment, ZCA 96
according to Exhibit “X’, dated January 7, 1998, attached hereto and mac
part hereof, based on the following findings:
Findings:
1. The Planning Commission finds that the project, as conditioned herein for ZCA
04, is in conformance with the Elements of the City’s General Plan. The General P
Land Use and Open Space and Conservation Elements include hills
preservation and design policies as follows:
a. Land Use Element Policy C.3 - Ensure that grading for building pads 2
roadways is accomplished in the manner that maintains the appearancc
natural hillsides.
b. Open Space and Conservation Element Policy C.3 - Assure t
development on hillsides relates to the slope of the land in order to prese
the integrity of the hillsides.
c. Open Space and Conservation Element Policy C.12 - Require that grad
be accomplished in a manner that will maintain the appearance of natu
hillsides and other landforms where possible.
d. Open Space and Conservation Element Policy C.14 - Implement ordinan
limiting density, intensity and character of development of hillside ar,
and ridges, and provide standards for sensitive grading where developm
of hillsides is allowed.
The proposed project is in conformance with these General Plan policies in tl
the hillside development and design standards and other ordinance revisic
proposed will function to regulate the grading and development of hillsid
thereby preserving the appearance and integrity of natural hillsides a
manufactured slopes.
2. This proposed zone code amendment achieves the overall project objecti.
including:
a. Streamlining the Hillside Development permit process;
b. Clarifying and simplifying the ordinance to make it more “user friend11
and
c. Incorporating new development standards to address identified ordinal:
issue areas.
