CASE NAME: LA VERCIA CONDOMINIUMS CASE NO.: CT 9 1-07x1 WHEREAS Roger Yazdi, “Developer”, has filed a verified application City of Carlsbad regarding property owned by Tamarack Partners, “Owner”, described Lot 8 Block S of Palisades 2, City of Carlsbad, according to Map 1803 filed on August 25,1924 (“the Property”); and WHEREAS, the City Council did, on December 2, 1992, adopt Commission Resolution No. 3469, approving the tentative map for a one lot/f subdivision, known as CT 91-07 a negative declaration, and condominium permit fo: 07x1 and CP 91-04; and WHEREAS, if the Planning Commission approves extension of the ‘ Map the related planning permits mentioned above will be automatically extended by ( of law pursuant to Carlsbad Municipal Code Section 21.58.020(b); and WHEREAS, the tentative map remained valid because of State legislath that extended all valid tentative maps; and WHEREAS, the tentative map will have expired on December 2, 195 extended. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) Be it resolved that Condition 19 of Planning Commission Resolu 3469 is hereby deleted. C) That based on the evidence presented at the public hearing, the Commission APPROVES the request for an extension of time for the tract map for Carlsbad Tract No. CT 91-07x1 and related planning permit 04) for a period of one year from December 2, 1997 to December subject to all the original conditions of approval; based on the following and the findings in Planning Commission Resolutions No. 3469 and 3 subject to the conditions therein. Findincs: - 1. That the design and improvements of the subdivision are consistent with the Plan, Titles 20 and 21 (CMC), other City ordinances and policies as conditioned. 2. That the subdivider is diligently pursuing those actions required to obtain a final 1 3. That the related planning permit remains consistent with current plans, policies ar 4. That the tentative map and related planning permits remain in prior compliance original environmental documents and mitigation requirements and that no circumstances or new impacts or mitigation measures will be required. 5. That the Planning Commission has reviewed each of the exactions imposed Developer contained in this resolution, and hereby finds, in this case, that the e are imposed to mitigate impacts cause by or reasonably related to the project, extent and the degree of the exaction is in rough proportionality to the impact c: the project. 6. That the project is consistent with the Housing Element of the General Plan Inclusionary Housing Ordinance as the Developer has been conditioned to inclusionary housing impact fee.
