CASE NAME: PAGENET TRAVELODGE FACILITY CASE NO.: CDP 98-02 WHEREAS, PageNet, Inc. “Developer”, has filed a verified application COASTAL DEVELOPMENT PERMIT NO. CDP 98-02 ON City of Carlsbad regarding property owned by John M. Tohidi, “Owner”, described as Lots 9 and 10 of Carlsbad Tract No. 81-05, in the City of Carlsbad, County of San Diego, State of California, according to map thereof No. 10899, filed in the Office of the County Recorder of San Diego County, April 11,1984. (“the Property”); and WHEREAS, said verified application constitutes a request for a Development Permit as shown on Exhibits “A” - “D” dated February 4, 1998, on f Planning Department, PAGENET TRAVELODGE FACILITY CDP 98-02, as pro Section 21.201.040 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 4th day of Februa hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all t and arguments, if any, of all persons desiring to be heard, said Commission considered a relating to the CDP. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. That the proposed development is in conformance with the Mello I Certifi Coastal Program and all applicable policies in that the roof mounted antenna! of a single suite to house equipment does not significantly disrupt existir serving commercial uses or obstruct views or otherwise damage visual res the area. 2. The project site is located within an existing development in the Me11 segment; therefore, it will not impact the Coastal Agricultural Overlay 201 not within the Coastal Shoreline Development Overlay Zone. The Travelodge motel development, in which the PageNet facility is p occupancy, complies with all applicable Mello I LCP segment Coastal 1 Overlay Zone and Coastal Resource Protection Overlay Zone standards. Conditions: 1. Staff is authorized and directed to make, or require the Developer to make, all c( and modifications to the site plan documents necessary to make them consistent and in conformity with the final action on the project. Developn occur substantially as shown on the approved Exhibits. Any proposed dev different from this approval, shall require an amendment to this approval. 2. The applicant shall apply for and be issued building permits for this projec two (2) years of approval or this coastal development permit will expir extended per Section 21.201.210 of the Zoning Ordinance. 3.
