A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
HILLSIDE DEVELOPMENT PERMIT TO DEVELOP AN 18
HOLE CHAMPIONSHIP GOLF COURSE WITH CLUBHOUSE
AND PRACTICE FACILITIES ON PROPERTY GENERALLY
LOCATED NORTH OF PALOMAR AIRPORT ROAD AND
EAST AND WEST OF COLLEGE AVENUE IN LOCAL
FACILITIES MANAGEMENT ZONES 5 AND 8

WHEREAS, The City of Carlsbad Municipal Projects Division, “De
has filed a verified application with the City of Carlsbad regarding property owned by

WHEREAS, said verified application constitutes a request for a
Development Permit as shown on Exhibit(s) c‘I’’-‘cJJ’ dated April 1, 1998, on fil

provided by Chapter 21.95 of the Carlsbad Municipal Code; and
WHEREAS, the Planning commission did on the 1st day of April 1998,
said request; and
WHEREAS, at said hearing, upon hearing and considering all testirr
arguments, if any, of all persons desiring to be heard, said Commission considered a
relating to the Hillside Development Permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the
Commission as follows:

A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Cor
APPROVES CARLSBAD MUNICIPAL GOLF COURSE, HDP 97-
on the following findings and subject to the following conditions:
Findings:
1. That hillside conditions have been properly identified on the constraints map whi
existing and proposed conditions and slope percentages;
2. That undevelopable areas of the project, i.e. slopes over 40%, have been
identified on the constraints map;
3. That as conditioned the development proposal is consistent with the intent, puq
requirements of the Hillside Ordinance, Chapter 21.95, in that hillside alteration
result in substantial damage or alteration of significant natural resourc
wildlife habitats or native vegetation areas; the natural appearance of hi1
preserved by assuring that development density and intensity relates to the
the land, and is compatible with hillside preservation; proper design is ut
grading, landscaping and in the development of structures and road1
preserve the natural appearance of hillsides; a healthful and aesthetically
environment is preserved and enhanced by assuring that hillside develoK
pleasing to the eye, rich in variety, highly identifiable, and reflects thl
cultural and environmental values; hillside conditions are properly identij
incorporated into the planning process; the intent of the land use ar
space/conservation elements of the Carlsbad General Plan are implemented;
is prevented and the lagoons protected from excessive siltation;
~ 4. That the development of structures will not occur in the undevelopable portior
site pursuant to provisions of Section 21.53.230 of the Carlsbad Municipal Code

1. Staff is authorized and directed to make, or require Developer to make, all co
